Lease Agreement between City of Pacifica and Stephen Johnson Photography RECOMMENDED ACTION:
Move to Adopt the Resolution titled, "A Resolution of the City Council of the City of Pacifica Approving the Lease Agreement Between the City of Pacifica and Stephen Johnson Photography for the Premises Located at 1220-C Linda Mar Boulevard (Located in the Sanchez Art Center)."

BACKGROUND/DISCUSSION:
The City of Pacifica and Stephen Johnson Photography first entered into an agreement to lease 3966 square feet of space with the Sanchez Art Center, located at 1220 Linda Mar Blvd, Pacifica, 94044, in October of 2004.
Since that time, the City has entered into 3 additional agreements and 4 extensions of agreements with Stephen Johnson Photography for this same space. The premises is used as an upscale photography studio, gallery, and business. Stephen Johnson Photography also conducts fee-based instructional and educational classes for the public, and hosts related public events as a resource for the City and the Community.
The Term of this proposed agreement is 1 year. The base rent is to be $2200 per month ($26,400 yearly) PLUS 12.2% of the Sanchez Art Center facility utilities. In addition, Stephen Johnson Photography has an outstanding balance of $6800 ($566.67 monthly) which will be paid in full by the end of the term of this agreement.
Stephen Johnson Photography has played a significant role in the arts space within the City of Pacifica. Stephen has photographed and documented many of the City’s civic events. He has performed on a number of different City commissioned projects including, but not limited to, the framed photos newly placed within the City Council Chambers.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
Enhance organizational and fiscal stability.
FISCAL IMPACT:
The one year term of this contract will bring the city $33,200 in revenue, not including the monthly 12.2% of the facility utilities.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PACIFICA APPROVING THE
LEASE AGREEMENT BETWEEN THE CITY OF PACIFICA AND STEPHEN JOHNSON PHOTOGRAPHY FOR THE PREMISES LOCATED AT 1220-C LINDA MAR BOULEVARD (LOCATED IN THE SANCHEZ ART CENTER)
WHEREAS, the City of Pacifica is the owner of the property located at 1220 Linda Mar Boulevard, Pacifica, California, (“Premises”); and
WHEREAS, Stephen Johnson Photography has leased the Premises located on this property for 19 years, functioning as an upscale photography studio, gallery and teaching facility; and
WHEREAS, the City and Stephen Johnson Photography wish to enter into a new lease agreement for a term of one year.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Pacifica as follows: The City Council hereby approves the Lease Agreement between the City of Pacifica and Stephen Johnson Photography, attached hereto.
