BACKGROUND/DISCUSSION:

In December of 2021, the City Council adopted an ordinance titled “Mandatory Organic Waste Disposal” to comply with state-mandated regulations surrounding SB 1383. SB 1383 refers to state regulations specific to solid waste reduction in California with the goal of reducing methane emissions. The focus of the law is to establish requirements for recycling organic waste and recovering edible food from residential and commercial waste generators to help fight climate change and improve public health and the environment.

Recology assists the city on implementation of components of the SB 1383 law such as pickup/processing of organic waste, monitoring of organic waste disposal and reporting. Also, San Mateo County (County) has assisted San Mateo cities in some of the more difficult requirements of the law such as the Edible Food Recovery Program (i.e. recovering food from facilities such as grocery stores for redistribution). Related to Pacifica, the County has contracted with Pacifica Resource Center (PRC) to expand PRC’s Edible Food Recovery Program and distribution capacity within the City to comply with SB 1383. Through this contact, the County provides PRC with funding to purchase refrigerated vehicles, hire drivers and admin staff, pick up surplus edible food from grocery stores and wholesalers and distribute collected food to community members in need.

In addition, the County is assisting San Mateo County cities with the SB 1383 requirement related to developing a procurement program for recycled organic waste products. Due to the inability for most cities to find a place to store the quantity of recycled products required by SB 1383 and the prohibitive cost, the County has developed an organic procurement program that supports farms and ranches and an educational outreach program that San Mateo cities can join to assist with meeting their SB 1383 procurement requirement. Recently, Pacifica received credit for our SB 1383 procurement requirement by contributing to this program through a $54,428 grant Pacifica received from CalRecycle in April of 2022. The City provided approximately 50% ($26,918.78) of the grant to the County for their SB 1383 programs and kept the remaining amount of $27,509.22 for procurement of mulch and compost for the City. requirements whether the City makes these efforts on its own or through the County. The grant can be used to pay for eligible SB 1383 implementation expenses, including edible food recovery program development.

Staff has made approximately $8,000 in purchases related to mulch and compost from the $27,509.22 grant portion kept by the City. However, the City does not have the space to purchase and store the large quantity of mulch/compost that would be needed to use the remainder of the grant by the grant deadline of May 2, 2024. Staff is recommending that the surplus of $19,052.55 of the City’s portion of the SB 1383 Local Assistance Grant Program from 2022 be transferred to the County for their use to support PCE’s Edible Food Recovery Program as described above. The budget modifications must be submitted by the County to CalRecycle no later than March 1, 2024.

To secure use of these funds towards Pacifica’s obligation under SB 1383, the City Manager recommends adopting a Resolution authorizing the City Manager to enter into a Memorandum of Understanding with the County of San Mateo supporting PCE’s Edible Food Recovery Program through transfer of these funds.

ALTERNATIVE ACTION:

The Council may choose not to adopt the Resolution. This could result in the City not meeting the mandated requirements of SB 1383 and losing this grant funding. Staff does not recommend this alternative action.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
• Pursue climate change adaptation and mitigation: The CalRecycle grant funds will be used to support reduction of methane gas emissions through support of the PCE’s Edible Food Recovery Program.

FISCAL IMPACT:

The fiscal impact of this action is the City will provide the County of San Mateo with $19,052.55 in surplus grant funding from CalRecycle’s 2022 SB 1383 Local Grant Assistance program to be used to support PCE’s Edible Food Recovery Program.
