COUNCIL AGENDA SUMMARY REPORT

1 SUBJECT:

Resolution Designating the City Manager and the Director of Public Works, by title, as Applicant's Agent for Non-State Agencies for the California Office of Emergency Services (CalOES) Public Assistance Programs
RECOMMENDED ACTION:

BACKGROUND/DISCUSSION:

During severe winter storms, the City experienced high/large wave events that caused damage to the city infrastructure. This included deposits of excess sand, damage to Pacifica Pier, Beach Blvd Seawall, and Milagra Outfall. The City can request funding assistance from the California Office of Emergency Services for costs incurred during disaster events.

In time of natural disasters, the Governor requests the Federal Government for the Declaration of Federal Emergency. If a Federal Emergency is declared, the Federal Emergency Management Agency (FEMA) distributes funds to the California Office of Emergency Services (CalOES) for the Public Assistance Program. Additionally, outside of disaster times, CalOES irregularly offers the Hazard Mitigation Grant Program to mitigate hazards before they occur.

The Public Assistance Program allows affected jurisdictions to recover up to 93.75% (75% FEMA, 18.75% CalOES) of eligible disaster related costs incurred during the disaster period.

The Hazard Mitigation Grant Program allows successfully applied for projects to receive 75% in project funding. CalOES requires the City to designate an "Applicant's Agent" through a City Council Resolution. This designation is required in order for the City to receive reimbursement. The attached resolution is in strict format of CalOES, and its adoption is required prior to the City receiving any reimbursement. The last Applicant’s Agent designation was authorized by the Council to the City Manager or Director of Public Works at 1/11/2021 Council meeting for three years and is now expired. This designation needs to again occur to allow the City to receive money from CalOES for emergency events.

• Improve and steward City Infrastructure, streets, and facilities: Adopting the resolution will make the funds available to fix city infrastructure damaged during emergency events.

FISCAL IMPACT:

None. Adoption of the attached resolution is a requirement by CalOES for the City to be eligible for Public Assistance Program funds.
