BACKGROUND/DISCUSSION:
On January 5, 2024, the City Manager, acting in his capacity as Director of Emergency Services, proclaimed the existence of a local emergency pursuant to PMC 4-2.05(a) and executed the "Proclamation of the Existence of a Local Emergency" ("Proclamation"). The proclamation was ratified by the City Council on January 8, 2024.
The storm event that occurred on December 28, 2023, resulted in dangerous conditions and public safety concerns, and caused damage to Pacifica’s coastline. The events brought large waves combined with high tides that damaged coastal access amenities at Beach Boulevard and Rockaway Beach. Damage included destroying bollards, trash cans, public benches, light posts, protective railings and flood damage. Additionally, the Pacifica Pier was damaged, requiring closure for public health and safety until assessment and repair can be completed.
The event also created a hole in the seawall at Beach Blvd. and San Jose Ave., requiring 300 square feet of area behind the seawall to be repaired to protect public infrastructure. Finally, the event brought significant amounts of sand onto the streets, parking lots and on top of the rock revetment south of the pier that needed to be cleared for safe public access and to protect the Beach Blvd. promenade.
MRC provided emergency repair of the seawall hole at the end of December/beginning of January 2024. In March of 2024, after receiving an Emergency Coastal Development Permit (ECDP) from the Coastal Commission, the City hired MRC to remove the sand off Beach Boulevard and relocate the sand to the public access beach entrance at 700 Palmetto Ave. In addition, MRC restacked the rock and brought in new rock to protect the Milagra Stormwater Outfall at the bottom of the access road that was damaged during the storm event. Following this work, MRC construction, under the ECDP requirements, removed sand from the top of the rock revetment south of the Pier and put this back on the beach to expose the seawall and allow Pacifica City Council 2

for more protection of the Beach Boulevard promenade and homes in the area. All work was completed on a time and materials basis and MRC has received payment for the work.
As noted in Section 3-15.09 (A) of the Pacifica Municipal Code, in cases of an emergency the City Manager is authorized to proceed at once to replace or repair any public facility without adopting plans, specifications, or working details, or giving notice for bids to let contracts.
The City must comply with Public Contract Code section 22050, which provides a process for City Council’s review of the emergency action if notice of bids to let contracts for public projects will not be given because of the emergency. Since January 8, 2024, this emergency project has been included to the Council in a monthly Council Report for the Continuation of Local Emergency of the High Tide/Large Wave event.
Based on previously reviewed costs from three contractors for a seawall hole that developed before the high tide/large wave emergency in November of 2023, the City received labor and material costs from MRC construction and has applied these costs to the events related to the high tide/large wave emergency. MRC construction has the most experience in addressing coastal emergency issues within Pacifica and made themselves readily available to complete this work within the time frame required by the emergency and stipulated by the California Coastal Commission ECDP.
City staff monitored the MRC work and verified the time to complete the work and equipment, labor and material required to complete the emergency repairs/work. MRC submitted their time and materials receipts for all work along with a pre-agreed upon price for the rock replacement for the Milagra Outfall repair. The time and materials work pays MRC all their labor, equipment, and material used to complete the projects and allows for agreed upon markups to account for overhead and profit. Following tabulation of these costs, the final cost for the emergency seawall repair work was $71,990. Removal of the sand from Beach Boulevard and rock replacement for Milagra Outfall was $87,884 ($74,254 + $13,630). Tabulated costs for the removal of the sand from the rock revetment south of the pier was $109,980. Although working with contractors on a time and materials basis requires significant staff oversight, ultimately, using this method of payment allows for a fair price to the City and fair compensation to the contractor. Additionally, it allows the City to adjust the work as needed to account for field conditions that must be addressed during the time of the work.
Therefore, the City Manager recommends approval for a Resolution accepting MRC’s invoices for $87,884 for the emergency work to remove the sand from Beach Boulevard and replace/repair the rock around the Milagra Outfall, $109,980 to remove the sand from the top of the rock revetment south of the pier and $71,990 to repair the seawall hole for a total cost of $269,854. All repairs were required due to the high tide/large wave event from December 28, 2023.
ALTERNATIVE ACTION:
There is no alternative action on this item as the emergency work has been completed.
