BACKGROUND:
With the passage of Proposition 64 in 2016, The Control, Regulate, and Tax Adult Use Marijuana Act (AUMA), California voters mandated the state to set aside funding for the CHP to provide grants to local governments and Qualified Nonprofit Organizations for the education, prevention, and enforcement of impaired driving laws pursuant to Section 34019 (f)(3)(B) Revenue and Taxation Code (RTC).
The Cannabis Tax Fund Grant Program funding for fiscal year 2024/25 is $13,000,000.00 statewide for the education, prevention, and the enforcement of laws related to driving under the influence of alcohol and other drugs, including cannabis and cannabis products.
The intent of the program is to educate the public regarding the dangers of impaired driving, enforce impaired driving laws on the roadway, and improve the Pacifica Police Department’s effectiveness through training and development of new strategies.
DISCUSSION:
Over the last several years, 75 injury collisions occurred in Pacifica. The total number of collisions in 2023 was 168. When the data for all reported collisions was evaluated, almost 40% were caused by impaired driving. Nearly 50% of all the reported collisions resulted in persons being injured, with many of them due to impaired/DUI drivers.
In the last three years, the Pacifica Police Department has made approximately 260 arrests for people driving while impaired. This is notable as there was a 12.5% increase in DUI arrests from 2022 to 2023.
Due to low staffing levels and budgetary constraints, the police department does not have the capacity to staff a specialized traffic unit. Any special enforcement operation or public education Pacifica City Council 2

presentation requires personnel to work overtime which is both costly and unsustainable. This grant award will enable the police department to fund saturation patrols, DUI checkpoints, and purchase a motorcycle necessary to conduct these effective interventions. The funds will also pay for educational presentations at our two local high schools.
Staff submitted a grant application requesting a total of $95,042.68 and received an award for the entire amount. The request included personnel costs for special enforcement/saturation patrols, educational presentations, and the cost of a new Harley Davidson police motorcycle.
ALTERNATIVE ACTION:
Council may choose not to adopt the resolution. However, not doing so will make the City ineligible to receive Cannabis Tax grant funding for the purposes of impaired driving education and enforcement.
RELATION TO CITY COUNCIL STRATEGIC GOAL 1:
• Enhance organizational and fiscal stability: Adopting the resolution will support the strategic initiative to pursue grant funding.
FISCAL IMPACT:
Adopting the resolution authorizing the acceptance of $95,042.68 from the state of California’s Cannabis Tax Fund Grant Program will bring this additional revenue to the City to be used for the education, prevention, and enforcement of impaired driving laws.
