Adopt a Resolution approving the Third Amendment to the Construction Services Agreement between the City of Pacifica and Chesterworks.
RECOMMENDED ACTION:
Move to adopt a Resolution to approve the Third Amendment to the Construction Services Agreement between the City of Pacifica and Chesterworks for construction management services for the Civic Center Project in the amount of $10,000 increasing the overall cost to $185,960.

BACKGROUND/DISCUSSION:
During the 2023/24 Mid-Year Budget Adjustment report, Council approved additional funding for the Civic Center project for the furniture, alarm system, window coverings, project contingency, IT needs and construction management. The mid-year budget added an additional $40,000 to the Chesterworks Civic Center construction management contract through mid-June to address the continuing construction of the Civic Center.
Chesterworks was hired by the city to provide construction management oversite on the Civic Center project. Chesterworks has extensive experience in oversite of public building construction and has been on the project since the start of the job. The Civic Center contractor’s late ordering for the switchgear pushed out the project schedule into August of 2024. Additional assistance from Chesterworks was needed to assess/manage final punchlist work, the alarm system installation, window coverings and Cort furniture installation. To address these needs a third amendment is needed to the Chesterworks agreement for an additional $10,000 for a total contract cost since spring of 2022 of $185,960 for construction management services. As the final completion of the Civic Center campus is anticipated shortly, no future additional funding will be required for the Chesterworks agreement.
The City Manager recommends that the Council approve a Resolution to approve the Third Amendment to the Construction Services Agreement between the City of Pacifica and Chesterworks for construction management services for the Civic Center Project in the amount of $10,000 increasing the overall cost to $185,960.
ALTERNATIVE ACTION:
Deny the proposed amendment to the Chesterworks agreement. This is not recommended as the work is required for final completion of the Civic Center campus.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
• Improve and Steward City Infrastructure, Streets and Facilities: Includes continuing projects that fix and improve the city infrastructure.
FISCAL IMPACT:
Funding needed for the Amendment was included previously in the FY 2023-24 Mid-Year Budget Adjustment approved by the City Council at the March 25, 2024 Council meeting.
Consequently, there is no fiscal impact to this action and no additional funding needed.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PACIFICA APPROVING THE
THIRD AMENDMENT TO THE CONSTRUCTION SERVICES AGREEMENT BETWEEN THE
CITY AND CHESTERWORKS FOR CONSTRUCTION MANAGEMENT SERVICES FOR THE CIVIC CENTER PROJECT IN THE AMOUNT OF $10,000 INCREASING THE OVERALL COST TO $185,960

WHEREAS, consistent with the City of Pacifica’s Purchasing Policy (Administrative Policy No. 76), the City of Pacifica entered into agreement with Chesterworks for construction management services; and
WHEREAS, on August, 2024; the City Council of the City of Pacifica considered the City Manager’s recommendation to approve a third amendment with Chesterworks for construction management services for the Civic Center Project;
NOW THEREFORE BE IT RESOLVED that the Council approves the Third Amendment to the Construction Services Agreement between the City of Pacifica and Chesterworks to the contract for construction management services for the Civic Center Project in the amount of $10,000 increasing the overall cost to $185,960. • • • • •
