RECOMMENDED ACTION:

Provide direction to Pacifica's voting delegate to support one resolution to be considered by the League of California Cities (CalCities) at the 2024 CalCities Annual Conference to be held in Long Beach, October 16 - 18, 2024 - Resolution on Fair and Equal Treatment of All Governmental Officials at All Levels as submitted by City of Glendora.

BACKGROUND/DISCUSSION:

Pacifica is a member of CalCities (formerly the League of California Cities), an association based in Sacramento that represents the interests of California's cities to the state legislature and provides cities with information on federal and state legislative and administrative affairs.

The CalCities 2024 Annual Conference is being held in Long Beach, October 16 - 18, 2024. The business meeting will be held at 8:30 a.m. on Friday, October 18, 2024 in the Long Beach Convention Center. At this meeting CalCities membership will consider and take action on one resolution that will be considered to take action on proposed Resolution on Fair and Equal Treatment of All Governmental Officials at All Levels as submitted by the City of Glendora.

CalCities has provided the 2024 Proposed ResolutionPacket (Attachment A) for consideration.

There were no additional resolutions submitted by the August 17 deadline for consideration at the League of California Cities 2024 Annual Conference General Assembly.

At its meeting on September 9, 2024, the Pacifica City Council selected Councilmember Boles as the voting delegate and Councilmember Bigstyck as the designated alternate for the General Assembly meeting to be held on Friday, October 18, 2024 at the CalCities 2024 Annual Conference at which the Resolution will be considered and voted upon.

The CalCities 2024 Resolution Packet (provided as Attachment A) includes information on the resolution process and voting procedures, the full text of the proposed resolution, background information, a summary of the League of California Cities staff analysis of the proposed resolution, and five letters of concurrence from Mayors of the cities Rancho Palos Verdes, Lomita, Azusa, Arcadia and La Verne. Specifically, the Resolution states that the League of California Cities shall call upon the Governor of the State of California and elected members of the California Legislature, including all members of the Senate and Assembly to adopt the following policy:

Pacifica City Council 2
September 23, 2024
"The California State Legislature shall not enact, and the Governor shall not sign into any law, any law or regulation that applies solely to elected officials of California cities and counties, unless such law or regulation also applies equally to members of the California State Assembly and Senate. This prohibition shall not apply to laws or regulations affecting the inherent powers of the legislative branch under the California Constitution." As provided in the Resolution and CalCities' staff analysis, examples of such rules or regulations already in place that apply to local city elected officials that do not otherwise also apply to elected officials of the State of California include:

1. California's open meeting rules as codified in the Ralph M. Brown Act (Government Code, Chapter 9, Sec. 54950 et. seq.), whereas the Bagley-Keene Open Meeting Act covers all state boards and commissions, and Government Code Sec. 9027 governs the State Legislature;

2. "One-off" exemptions, in the form of Senate Bill No. 174, from the California Environmental Quality Act ("CEQA");

3. Rules in the form of Senate Bill No. 1439 (Glazer), amending the Political Reform Act, aimed at preventing "pay-to-play" practices by prohibiting parties, participants and agents in a proceeding involving a license, permit, or other entitlement for use from contributing more than $250 to an officer of an agency during a 12-month period;

4. Rules in the form of Assembly Bill No. 571 (Mullin), that apply to city and county candidates for local elected office, but not to candidates for state-wide office, which allows for a city to elect to have "no" campaign contribution limit or establish its own contribution limits.

The City Manager recommends that Pacifica's voting delegate communicate the City of Pacifica's position on the proposed resolution as follows: Support.

ALTERNATIVE ACTION:

The City Council may alternatively direct Pacifica's voting delegate to Disapprove or Take No Action on the resolution on Fair and Equal Treatment of All Governmental Officials at All Levels as submitted by City of Glendora.

FISCAL IMPACT:

None.
