BACKGROUND/DISCUSSION:
The City of Pacifica and the Jefferson Union High School District (JUHSD) have collaborated on shared recreational facilities since October 19, 1976, when they established a Joint Powers Agreement (JPA) to facilitate the construction and operation of what is now the Jean E. Brink Pool, formerly known as the Oceana Natatorium. This agreement has provided students and the broader Pacifica community with access to aquatic programs while ensuring the facility remains well-maintained. The JPA, which remains in effect, is set to expire on January 1, 2027.
Over the years, the City and JUHSD refined their partnership through a series of Memoranda of Understanding (MOUs) to clarify responsibilities related to facility use, maintenance, and costsharing. The first MOU in 1987 expanded the agreement to include the Terra Nova Pool, Oceana Natatorium, and adjacent tennis courts. Subsequent MOUs in 1997 and 2011 further addressed operational and financial arrangements, ensuring the facilities remained sustainable for both student-athletes and community members.
The proposed 2025 MOU would replace prior agreements regarding shared use of the facilities.
The proposed MOU has clearer language and a streamlined payment structure, while preserving the core terms of the partnership.
Use of the Jean E. Brink Pool
A key addition to the proposed MOU is Attachment #1, which provides explicit guidelines for post-event cleaning responsibilities at the Jean E. Brink Pool. These include disinfecting pool fixtures, restocking restrooms and locker rooms, wiping down tiles and door frames, mopping floors, and ensuring all entryways, seating areas, and the pool deck are properly cleaned.
These defined expectations will help maintain the facility’s condition and improve operational efficiency.

Previously, cost-sharing calculations for the Jean E. Brink Pool were complex, requiring both parties to track pool usage hours and divide costs for utilities, heating, water, custodial services, and general upkeep. This placed a significant administrative burden on District staff, particularly given fluctuating utility rates. To simplify this process, the City and JUHSD agreed to a fixed-rate payment model with a 3% annual increase, reducing administrative workload and improving budget predictability.
Under the new terms, the City will make set payments to JUHSD for use of the Jean E. Brink Pool:
• $190,000 for fiscal year 2024/25
• $195,700 for fiscal year 2025/26
• $100,785.50 for the first half of fiscal year 2026/27 (as the JPA and this MOU expire on December 31, 2026)
Under the proposed MOU, the City and District would share the use of the Jean E. Brink Pool, adjoining locker rooms, bathrooms and the bleachers. The City would be able to use the Jean E. Brink Pool at all time except when the Pool is being used by Oceana High School for Physical Education or Swim Team activities or if needed for other JUHSD activities. The City would also have exclusive use of the office space and storage space adjoining the Jean E. Brink Pool. The proposed MOU also provides that the City will perform the regular custodial services for the Jean E. Brink Pool while JUHSD will provide specified custodial services for certain Physical Education and swim meet events.
Use of Terra Nova Pool
The proposed MOU provides that the City may request the use of the Terra Nova pool for summer programs. For the summer of 2025, the cost will be $ 30.60 per hour.
Use of Terra Nova Tennis Courts
Under the proposed MOU, the City will manage the operation and scheduling of tennis court lights and the City shall also cover the cost of all utilities. The City and the District will share the costs for replacement of nets and major repairs or replacement of court surfaces, with the City paying 40% and the District paying 60%. The proposed MOU provides that the City would have the use of the tennis courts from 5:00 p.m. through 9:00 p.m., Monday through Friday, during the school year, and between 8:00 a.m. and 9:00 p.m. on Saturdays, Sundays, school vacation periods and holidays. The above schedule is subject to change based on the tennis seasons as set by the Peninsula Athletic League, at which time the District shall have the right to use the courts until 6:00 p.m. or until the completion of scheduled tennis matches.
This proposed MOU serves as a transitional bridge between the current JPA and a future rental agreement, as ownership of the pool reverts fully to JUHSD on January 1, 2027. Before this transition, City staff will negotiate a new agreement under Council direction to establish terms for continued City use of the facility beyond the JPA’s expiration.
Importantly, this proposed MOU does not alter facility hours, programming, or access for either party. It simply refines existing agreements to reflect operational realities and ensure long-term sustainability. By entering into this new MOU, the City and JUHSD reaffirm their commitment to shared recreational opportunities while strengthening their cooperative relationship for the benefit of the Pacifica community.
