BACKGROUND/DISCUSSION:
On January 4, 2023, the City Manager, acting in his capacity as Director of Emergency Services, proclaimed the existence of a local emergency pursuant to PMC 4-2.05(a) and executed the "Proclamation of the Existence of a Local Emergency" ("Proclamation").
The President declared a major disaster for the State of California on January 14, 2023 as a result of the severe winter storms, flooding, landslides and mudslides that began on December 27, 2022. This declaration, FEMA-4683-DR-CA, has authorized Individual Assistance for several Counties throughout California, including San Mateo County. Numerous projects were included in the City of Pacifica list of damaged sites, inspected by FEMA and approved for Public Assistance.
The storm events that started on December 31, 2022, resulted in dangerous conditions and public safety concerns and caused damage all around the Bay Area. Like many other Bay Area Cities, Pacifica received 4.6" of rain in 24 hours, which resulted in severe flooding, road closures, fallen trees, and sanitary sewer overflow events.
On March 16, 2023, the City Manager, acting as Director of Emergency Services, approved the Urgent Purchase Justification Memorandum for the Disaster Cost Recovery and Grant Pacifica City Council 2
April 28, 2025
Management services in connection with 2023 California Storm Disaster at a total cost of $45,000.00 from Kermani Consulting Group. The existing contract budget has now been fully expended, and the amendment will increase by an amount of $50,000 for a total contract amount of $95,000.
The City would like to continue the consulting services for disaster cost recovery, grant management services and to provide assistance with obtaining the necessary approvals from the State of California Office of Emergency Services (CalOES) and Federal Emergency Management Agency (FEMA) for the reimbursement of the costs related to 2023 winter Storm disasters and other eligible activities under the Public Assistance (PA) and CDAA programs.
Currently, the reimbursements have taken several rounds of reviews by FEMA, and there have been appeals on some of the disaster area repairs project scoping which were denied. Although the repair project scoping presented to FEMA has been denied, none of the city appeals have been denied at this time, and this amendment is for Kermani Consulting Group to assist the city in the anticipated appeal process for each project that has been denied.
The city has already received reimbursement and obligation for $483,631.68 from FEMA. The remaining projects that are being appealed include the Landslide Stabilization and Repairs project, the Emergency Protective Measures (includes force account labor, rentals, purchases), and two more slope stabilization projects which in total add up to approximately $850,000 to $900,000.
ALTERNATIVE ACTION:
The Council may choose not to approve the additional budget authority with Kermani Consulting Group. However, there are still numerous important storm damage repair projects still to be done, and a consultant is needed to assist the City with FEMA and CalOES disaster cost recovery and grant management services. The City Manager does not recommend this alternate action.
RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
Approval of the Resolution is consistent with the following Council adopted Goals:
• Enhance organizational and fiscal stability: FEMA and CalOES disaster funds will provide vital financing mechanisms to repair City infrastructure. • Improve and steward City infrastructure, streets and facilities: FEMA and CalOES disaster funds will assist to repair City infrastructure damaged by the 2023 Winter Storm.
FISCAL IMPACT:
City staff have applied for FEMA Public Assistance and would reimburse the City 25% of the consultant services. City matching funds of 75% of the $50,000 amendment will come from the Disaster Accounting Fund.
