Re: Notice of Expiration of Cannabis Public Safety License/Termination of Cannabis Activity Permit and Cessation of Operations
Dear Ms. Williams,
This letter is to inform you that your Cannabis Public Safety License ("CPSL") expired on October 16, 2024. Seaweed failed to renew the license and pay the annual renewal fee at least thirty (30) days prior the expiration of the CPSL as required by Pacifica Municipal Code ("PMC") section 4-16.06 (d). This lapse in renewal of a CPSL results in automatic expiration of the CPSL. (PMC section 4-16.06). The expiration of the CPSL also results in automatic termination of the right to operate a cannabis operation under a cannabis activity permit ("CAP"). (PMC sections 9-4.4803(b) and (d) and 9-4.4806(d)).
As a result of the expiration of the CPSL and termination of the CAP, Seaweed is currently operating without a valid CPSL and CAP. It is unlawful for any person to engage in, to conduct or carry on the operation of a cannabis operation unless that person has first obtained and continues to maintain in full force and effect a valid CAP issued by the City for that property and that type of cannabis operation and a valid CPSL issued by the City to the owner and/or operator of the cannabis operation. (PMC sections 4-
16.03(a) and 9-4.4803(b)).
Since Seaweed does not have a valid CPSL nor a valid CAP, you must immediately cease Seaweed's cannabis business operations. If you do not immediately cease operations, the City will take any legal steps necessary to enforce the requirements in the PMC, including, but not limited to, the issuance of administrative citations for each and every day that an ongoing violation occurs pursuant to PMC section 1-6.04.

If you desire to seek a new CPSL and CAP to operate a cannabis retail business in the City of Pacifica, you must file a new application for those permits, which will be reviewed by the City in accordance with the process specified in PMC Sections 4-16.01 et seq., and 9-4.4800 et seq.
You may appeal this determination pursuant to MC section 1-4.01 by filing a notice of appeal with the City Clerk and paying any applicable appeal fee within ten (10) days of the date of this Notice.
