BACKGROUND:
With the passage of Proposition 64 in 2016, The Control, Regulate, and Tax Adult Use Marijuana Act (AUMA), California voters mandated the state to set aside funding for the CHP to provide grants to local governments and Qualified Nonprofit Organizations for the education, prevention, and enforcement of impaired driving laws pursuant to Section 34019 (f)(3)(B) Revenue and Taxation Code (RTC).
The Cannabis Tax Fund Grant Program funding statewide for fiscal year 2025/2026 is $13,000,000.00 for the education, prevention, and the enforcement of laws related to driving under the influence of alcohol and other drugs, including cannabis and cannabis products.
The intent of the program is to educate the public regarding the dangers of impaired driving, enforce impaired driving laws on the roadway, and improve the Pacifica Police Department’s effectiveness through training and development of new strategies.
DISCUSSION:
Over the last two years, 359 traffic collisions occurred in Pacifica with 157 of those involving injuries. When the data for all reported collisions was evaluated, almost 20% were caused by impaired driving. Nearly 40% of all the reported collisions resulted in persons being injured, with many of them due to drivers under the influence of alcohol or drugs (DUI/DUI Drug).
In 2023 and 2024, the Pacifica Police Department has made approximately 173 arrests for people driving while impaired. Fifty-nine of these DUI/DUI Drug arrests involved a traffic collision where driving while impaired was the primary collision factor.
Due to low staffing levels and budgetary constraints, the police department does not have the capacity to staff a specialized traffic unit. Any special enforcement operation or public education presentation requires personnel to work overtime which is both costly and challenging to Pacifica City Council 2

sustain. This grant award will enable the police department to fund DUI/DUI Drug saturation patrols, and purchase a TruNarc Narcotics Analyzer to conduct these effective interventions.
The TruNarc Narcotics Analyzer is a handheld device used by law enforcement and forensic professionals for rapid, on-site drug identification.
Staff submitted a grant application requesting a total of $68,895.20 and received an award for the entire amount. The request included personnel costs for special enforcement/saturation patrols, educational presentations, and the cost of a new TruNarc Narcotics Analyzer.
ALTERNATIVE ACTION:
Council may choose not to adopt the resolution. However, not doing so will make the City ineligible to receive Cannabis Tax grant funding for the purposes of impaired driving education and enforcement.
RELATION TO CITY COUNCIL STRATEGIC GOAL 1:
• Enhance organizational and fiscal stability: Adopting the resolution will support the strategic initiative to pursue grant funding.
FISCAL IMPACT:
Adopting the resolution authorizing the acceptance of $68,895.20 from the state of California’s Cannabis Tax Fund Grant Program to be used for the education, prevention, and enforcement of impaired driving laws.
