BACKGROUND/DISCUSSION:

On March 10, 2025, City Council Authorize the City Manager to Award and Execute a Construction Agreement and a Construction Management Agreement for the FY 2025-26 Concrete Improvement Project. The project installed 23 new ADA curb ramps, sidewalks, and other miscellaneous related work. The project was funded by Measure W funds.

There were two change orders issued to the contractor, John Boylan Engineering, Inc., during the course of construction, totaling $27,146.24. These change orders covered the addition of an ADA-compliant pathway connecting to the coastal trail along the beach, and the installation of a catch basin at an existing curb ramp to reroute water and address a ponding issue. With these changes, the final construction cost for the project was $362,044.84.

As the project is now complete and staff is satisfied with the contractor’s work on the project, it is appropriate to record the formal Notice of Completion with the San Mateo County Recorder's Office. This recorded document is the legal notice that the City considers the project complete and that we intend to pay the contractor for the full and complete contract price. This also puts all subcontractors and suppliers on notice that if they have any claims for payment from the contractor, they have 30 days to file claims for payment against the City. This provision of contract law protects subcontractors from contractors who may not pay them properly. It also protects the City from claims against us for any nonpayment on the part of the contractor. The City withheld 5% of the final contract amount, $18,102.24, as retention to make sure that all Pacifica City Council 2

subcontractors and suppliers have been paid. The City will release the retention if no claims are received.

The City Manager is recommending the adoption of the attached resolution accepting completion of the project and the filing of the Notice of Completion (Attachment 1) with the San Mateo County Recorder's Office.

ALTERNATIVE ACTION:

Council may choose not to adopt the resolution accepting completion of the project, but as the work has been satisfactorily completed, the contractor may file a claim against the City for nonpayment of retention, if there are no claims.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:

Approval of the Notice of Completion for the FY 2025-26 Concrete Improvement Project is consistent with the following Council adopted Goals:
• Maintaining a Safe Community: This project installed curb ramps, sidewalks and curb and gutters that will promote public health and safety.

FISCAL IMPACT:
