Removal of Member of Beautification Advisory Committee for Failure to Meet Attendance Requirements Contained in Section 2-2.116 of the Pacifica Municipal Code RECOMMENDED ACTION:
Motion to remove Committee Member Snezana (Sue) Markovic-Garza from the Beautification Advisory Committee and direct the City Clerk to advertise vacancy of one partial term on the Committee.

BACKGROUND:
Title 2, Chapter 2 of the Pacifica Municipal Code sets out general provisions for City Commissions and Committees and contains specific provisions regarding attendance requirements and removal of members.
Section 2-2.107 states:
The Council may remove at any time by majority vote any commission or committee member.
Section 2-2.116 states:
All commission and committee members are expected to attend all of their respective meetings and shall make every effort to do so. Absence from three (3) consecutive meetings or absence from more than one-third (1/3) of all meetings in one calendar year shall constitute a failure to discharge the duties of office and may subject the committee or commission member to removal by the Council.
DISCUSSION:
Committee Member Snezana (Sue) Markovic-Garza has not attended Beautification Advisory Committee meetings since December 2024, and now exceeds the three (3) consecutive meeting absence and the one-third of all meetings in one calendar year threshold as set forth in PMC Section 2-2.116. Committee Member Garza was absent from Beautification Advisory Committee Meetings on December 4, 2024; January 8, 2025; March 5, 2025; April 2, 2025; May 7, 2025; June 26, 2025; and August 6, 2025. This does not take cancelled meetings into account (the February 5, 2025 and July 2, 2025 meetings were cancelled).

staff liaison of the committee may result in difficulty to achieve a quorum in attendance and may impact the committee’s ability to hold a public meeting in accordance with the Ralph M. Brown Act. For example, the February 5, 2025 regular Beautification Advisory Committee Meeting was cancelled due to lack of quorum.
Committee Member Garza was notified and provided with an opportunity to resign prior to agendizing this item for action. However, no response was received prior to agenda release time.
ALTERNATIVE ACTION:
The City Council may decide to not remove Committee Member Garza; however, the recommended motion is consistent with Municipal Code requirements. Committee Member Garza’s term expires in March 2026.
