BACKGROUND/DISCUSSION:

On January 13, 2025, City Council authorized the City Manager to Award and Execute a Construction Agreement for the Sharp Park PDA Pedestrian Improvements Project. The Sharp Park Priority Development Area (PDA) Pedestrian Improvement Project closed sidewalk gaps, improved sidewalks to current ADA standards, installed new ADA compliant driveways and corner curb ramps, installed curb and gutter to improve storm water management, removed and replaced failed pavement, installed Bicycle Boulevard (Paloma) and pedestrian crossing striping, and resurfaced roads with slurry seal along Paloma Avenue, Carmel Avenue and Santa Maria Avenue from Francisco Boulevard to Beach Boulevard. The new driveways and sidewalks provided an ADA compliant path of travel in the project area and provided a vital link for pedestrians and bicyclists from the eastern residential neighborhood of Pacifica to the Sharp Park district, Palmetto business area, Pacifica Civic Center, two schools, the Sharp Park Library, and the popular Sharp Park Beach, and Pacifica Pier. The project was funded by the One Bay Area Grant 2, Measure M Grant, and Measure W (Fund 11).

There were 25 change orders issued to the contractor, JJR Construction, Inc., over the course of construction. The total change order amount was $390,360.13 and included additional sidewalk, driveways, curb & gutter, and curb ramps, additional work for removal and planting of 3 additional trees, relocation of water meters, and additional resurfacing and striping Pacifica City Council 2

improvements. The final contractor construction cost for the project was $2,029,838.34.

As the project is now complete and staff is satisfied with the contractor’s work on the project, it is appropriate to record the formal Notice of Completion with the San Mateo County Recorder's Office. This recorded document is the legal notice that the City considers the project complete and that we intend to pay the contractor for the full and complete contract price. This also puts all subcontractors and suppliers on notice that if they have any claims for payment from the contractor, they have 30 days to file claims for payment against the City. This provision of contract law protects subcontractors from contractors who may not pay them properly. It also protects the City from claims against us for any nonpayment on the part of the contractor. The City withheld 5% of the contract amount, $101,491.92, as retention to make sure that all subcontractors and suppliers have been paid. The City will release the retention if no claims are received. The project plans are also available to view on the City's website at:
https://www.cityofpacifica.org/departments/public-works/engineering/capital-improvementprojects/sharp-park-pda-pedestrian-improvement-project.

The City Manager is recommending the adoption of the attached resolution accepting completion of the project and the filing of the Notice of Completion (Attachment 1) with the San Mateo County Recorder's Office.

There is no fiscal impact associated with the filing of the Notice of Completion. The total project Source and Use of Funds table is shown below. The project balance will remain in the Fund 11 - Measure W.
