BACKGROUND/DISCUSSION:
On January 13, 2025, the City Council authorized the City Manager to execute a construction agreement with Dryco Construction, Inc. (Dryco) for the Esplanade & Palmetto Bicycle and Pedestrian Improvement Project. The project implemented improvements identified in the City’s 2020 Bicycle and Pedestrian Master Plan, including installation of Class 2, 2B, and 3 bike lanes, new Class 3B bicycle boulevards, painted bulbouts, upgraded curb ramps, high-visibility crosswalks, and roadway resurfacing to provide a safer, smoother surface.
There were six change orders issued to Dryco over the course of construction totaling $104,527. These included a drainage inlet tie-in, push button extensions for ADA compliance, asphalt conform corrections at curb ramps, red curb painting, a concrete median, and a quantity adjustments. The final construction cost for the project was $1,276,277.60.
As the project is now complete and staff is satisfied with the contractor’s work on the project, it is appropriate to record the formal Notice of Completion with the San Mateo County Recorder’s Office. This document is the legal notice that the City considers the project complete and that we intend to pay the contractor for the full and complete contract price of the work actually completed. This also puts all subcontractors and suppliers on notice that if they have any claims for payment from the contractor, they have 30 days to file claims for payment against the City.
This provision of contract law protects subcontractors from contractors who may not pay them Pacifica City Council 2

properly. It also protects the City from claims against us for any nonpayment on the part of the contractor. The City withheld 5% of the final contract amount, $63,813.88, as retention to make sure that all subcontractors and suppliers have been paid. The City will release the retention if no claims are received. The project plans are also available to view on the City's website at:

• Stewardship of City Infrastructure: Includes repairing/replacing outdated city facilities such as city hall, the libraries, fire stations, etc., improving streets, and responding to impacts of sea level rise. This construction project will improve the existing bicycle and pedestrian network by improving the safety and usability of existing bike lanes and pedestrian facilities.
