COUNCIL AGENDA SUMMARY REPORT
11/24/2025
1 SUBJECT:

First Amendment to Lease Agreement with Pacifica Performances for Use of a Portion of the Sanchez Art Center
RECOMMENDED ACTION:

Adopt the Resolution authorizing the City Manager to execute the First Amendment to Lease Agreement between the City of Pacifica and Pacifica Performances, extending the lease term through December 31, 2030, and updating rent, utility, and financial reporting provisions.

BACKGROUND/DISCUSSION:

Pacifica Performances is a nonprofit performing arts organization that provides live music and cultural programming at the Sanchez Center campus. The City currently leases space to Pacifica Performances, including the multipurpose room commonly used as a concert hall, an administrative office, a kitchen, and restrooms. The current lease expires on December 31, 2025.

To support the continuation of arts and cultural programming, the City and Pacifica Performances desire to extend the agreement. The First Amendment to Lease Agreement extends the lease term for one year beginning January 1, 2026, with four additional one-year renewal options that may extend the agreement through December 31, 2030. The amendment also updates the Base Rent to $4,565 per year and requires a fixed annual amount of $4,440 to cover water, sewer, and electricity utilities. A 2.5 percent annual increase will apply to Base Rent starting January 1, 2027.

Pacifica Performances will continue to remit 25 percent of all sublease rental revenue to the City and will submit semi-annual financial reports to the Finance Director each year. Annual proof of nonprofit status will also continue to be required. The agreement maintains a long-standing and valued partnership that supports accessible cultural programming for the community while recovering a reasonable portion of City costs associated with the facility.

ALTERNATIVE ACTION:

Do not approve the agreement and provide staff with alternative direction.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:

Pacifica City Council 2
November 24, 2025
Approval of this item supports the City Council’s goal of fostering a healthy and compassionate community by continuing to provide residents with access to arts and cultural experiences.

ENVIRONMENTAL REVIEW:

Approval of the proposed Agreement with Pacifica Performances is not subject to review under the California Environmental Quality Act (CEQA) pursuant to Public Resources Code Section 21000, et seq. and the CEQA Guidelines (14 Cal. Code Regs. §§ 15000 et. seq.), including without limitation, Public Resources Code section 21065 and California Code of Regulations 15378 as this is not a “project” that may cause a direct, or reasonably foreseeable indirect, physical change in the environment
FISCAL IMPACT:

Lease payments and revenue-sharing funds will continue to be received into the City’s General Fund. The First Amendment provides predictable and modestly increased revenue to support the City’s efforts to maintain the property and ensure community use of the campus.
