1 SUBJECT:

Fourth Amendment to the Consultant Services Agreement between the City of Pacifica and Eisenberg, Olivieri & Associates Inc. for Commercial and Industrial Stormwater Inspections and Related Services
RECOMMENDED ACTION:

Adopt the Resolution entitled “A Resolution of the City Council of the City of Pacifica Approving Fourth Amendment to the Consultant Services Agreement between the City of Pacifica and Eisenberg, Olivieri & Associates Inc. for Commercial and Industrial Stormwater Inspections and Related Services and authorize the City Manager to execute all documents.

BACKGROUND/DISCUSSION:

Commercial and Industrial Stormwater Inspections is a requirement of the San Francisco Bay Municipal Regional Stormwater NPDES Permit Order No. R2-2022-0018 (MRP). Each permittee is required to conduct inspections, effective follow-up, and enforcement to abate potential and actual non-stormwater discharges. These efforts prevent the discharge of pollutants and impacts to beneficial uses of receiving waters.

On December 11, 2017, the City Council approved a Consultant Services Agreement with Eisenberg, Olivieri & Associates, Inc. (EOA) to perform Commercial and Industrial Stormwater Inspections and related services. Since then, the agreement has been periodically amended to extend its term and align with ongoing Municipal Regional Permit compliance cycles.

EOA has a long history of supporting both the City of Pacifica and the San Mateo Countywide Water Pollution Prevention Program (SMCWPPP) with the implementation of MRP Provision C.4 Industrial and Commercial Site Controls requirements. EOA has also developed many of the tools and guidance documents used by SMCWPPP member agencies to maintain compliance with the MRP.

To maintain consistency with the current MRP 3.0 permit term (2022-2027), the City anticipates 9 Packet Pg. 192

continuing to amend this agreement annually through the end of the permit period. The proposed Fourth Amendment will extend the contract through July 30, 2026 to align with the duration of MRP 3.0.

The City Manager recommends adopting the resolution and approving the Fourth Amendment (Attachment 1) to the Consultant Services Agreement between the City of Pacifica and EOA.

ALTERNATIVE ACTION:

The Council may choose not to approve the amendment. This could result in the City not meeting Municipal Regional Stormwater Permit requirements. Staff does not recommend this alternative action.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
· Stewardship of City Infrastructure includes repairing/replacing outdated city facilities, improving streets, stormwater and wastewater infrastructure and responding to impacts of sea level rise and other effects of climate change
Approving the Consultant Services Amendment will provide needed inspections services that will continue to protect the environment and assist the City with MRP compliance.

FISCAL IMPACT:

Use of Funds
Inspection services $50,000.00
Total Use of Funds $50,000.00

Source of Funds
NPDES Fund 16 $50,000.00
Total Source of Funds $50,000.00
Fiscal Impact will be in the amount of $50,000 in contractual services and is offset by Stormwater Inspection fees.

(CSA) for Geotechnical Services for landslide repair and FEMA related projects in an amount of $71,680.00, increasing the budget authority with a 10% contingency to $313,438.00 and authorize the City Manager to execute all document related to the Geotechnical Services.”

BACKGROUND/DISCUSSION:

On May 13, 2024, the City of Pacifica approved a Master Consultant Services Agreement and Task Order No. 1 with Cotton Shires and Associates (CSA) to initiate preliminary studies, including topographic surveying and geotechnical and slope stability analyses, for multiple landslide sites within the City. Following recent FEMA and Cal OES obligation of four of these landslide repair projects, staff recommends approval of a budget amendment to the CSA contract in the amount of $71,680.00 to complete the Plans, Specifications, and Estimates (PS&E) necessary to prepare the projects for construction. With this amendment, the total CSA contract amount would increase to $291,460.00.

The proposal from CSA includes preparation of Plans, Specifications, and Estimates (PS&E) for the landslide repair projects located at 1475 Rosita Road and along Sharp Park Road. In addition, CSA will revise the existing designs and complete the PS&E for the Adobe Drive and Higgins Way retaining wall project and the 601 Talbot Avenue sewer pipeline replacement project. During the winter storms in 2023, at 1475 Rosita Ave, a landslide of approximately 50 feet in length and 5 feet in height slid into the Adobe Creek and left the resident’s backyard unstable and CSA’s design calls to replace with a keyway and fill and compact to match what was existing prior to the storm damages. At 601 Talbot, a landslide of approximately 100 feet 10 Packet Pg. 198
Pacifica City Council 2

wide, 25 feet high, and 25 feet deep crushed the sewerline that serves several houses on Talbot Ave and CSA’s design calls to trench through the compacted debris and replace the whole line.

On the corner of Adobe & Higgins, the retaining wall in the City’s right of way was damaged by the major storms and caused about 65 feet wide of the wall to collapse and CSA is designing to replace the entire 100 foot wide retaining wall. At Sharp Park Road, the hillside gradually eroded over several years and CSA is working with a structural engineer to design a new retaining wall/v-ditch at the top of the hillside.

The City Manager recommends approval of Amendment No. 1 with Cotton, Shires and Associates, Inc.

ALTERNATIVE ACTION:

The Council may choose not to approve the amendment and agreement. Staff does not recommend this alternative action.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
· Improve and steward City infrastructure, streets and facilities: The repair of the storm damage will improve the areas and prevent further damage.

FISCAL IMPACT:

The original contract of $219,780.00 was from the Disaster Accounting Fund 38. The Talbot Avenue and Rosita Road has been approved by Federal Emergency Management Agency (FEMA), and Adobe Drive is in the last approval stage. Staff is requesting reimbursement from the Federal Emergency Management Agency (FEMA) for the geotechnical services.

The funds for Sharp Park Road was approved from Disaster Accounting Fund 38 as part of the FY 25-26 budget for the Sharp Park Road Slope Erosion Repair Project.

Mr. Bryan Bautista

CITY OF PACIFICA

SUBJECT: Proposal For Supplemental Geotechnical and Civil Services RE:   CITY OF PACIFICA
Adobe Drive (opposite 1580/1590 Higgins), Sewer at 601 Talbot Avenue, 1475 Rosita Road, and Sharp Park Road
Pacifica, California
Dear Mr. Bautista:

Cotton, Shires and Associates, Inc. (CSA) is pleased to provide the City of Pacifica (City) with this proposal for supplemental geotechnical and civil services.   It is our understanding that the City would like CSA to prepare civil drawings and technical specifications for two landslide impacted sites which CSA previously mapped and evaluated including 1475 Rosita Road, and Sharp Park Road. We also understand that the City would like CSA to revise previously prepared civil plans and specifications to address anticipated City comments for a retaining wall replacement at Adobe Drive (opposite 1580/1590 Higgins), and a sewer pipeline replacement downslope of 601 Talbot Avenue.

We propose the following Scope of Work, Cost and Budget Breakdown and Schedule to perform the requested geotechnical and civil services for each of the selected four sites.

SCOPE OF WORK
We have organized the proposed scope of work for each of the four sites in the following section.

1475 ROSITA ROAD
It is our understanding that the City would like CSA to prepare plans and technical specifications to restore the slope damaged by a landslide located above a shotcrete wall along the southern bank of San Pedro Creek, adjacent to the backyard at 1475 Rosita Road.

We also anticipate that the slope restoration will include a geogrid, reinforced engineered slope, a backdrain, and removal of trees. CSA previously prepared a topographic map, drilled borings, completed laboratory testing, prepared a cross section, completed slope stability analysis, and developed mitigation alternatives. We understand that the City has selected the grading alternative to restore the slope. We also understand that the homeowner requests a roughly 6‐ to 7‐foot wide level or gently slopeed area beyond their fence.

We propose to prepare plans and technical specifications using the previously prepared topographic map as a base.

I. Complete Design, Prepare Draft and Final Plans and Technical Specification
A. We will prepare a draft set of plans and technical specifications for City comments.

B. We will respond to City comments and prepare a final set of plans and technical specifications
II. Project Management
A. Project Management – We will provide Project Management throughout the project.

B. Site Visits – We will complete two site visits to confirm site conditions and suitability of design.

C. Quantities and Engineer’s Cost Estimate – We will calculate construction quantities and develop an engineer’s construction cost estimate using unit costs from previous bids.

SHARP PARK ROAD
It is our understanding that the City would like CSA to prepare plans and technical specifications to support the portions of the concrete lined V‐ditch undermined by a recent

landslide located on a slope above Sharp Park Road. We previously mapped the site and provided the City with two alternatives to address the undermined V‐ditch. We recommend that the City replace the undermined section of V‐ditch with a new V‐ditch section that is designed as a retaining wall to span an unsupported 15‐foot section.

We propose to prepare plans and technical specifications using the previously prepared topographic map as a base.

I. Complete Design, Prepare Draft and Final Plans and Technical Specification
A. We will consult with a Structural Engineer to assist us with the V‐ ditch retaining wall design.

B. We will prepare a draft set of plans and technical specifications for City comments.

ADOBE DRIVE (OPPOSITE 1580/1590 HIGGINS)
It is our understanding that the City would like CSA to revise the previously prepared plans and technical specification to incorporate City comments, and to revise the engineers cost estimate.

construction cost estimate using updated unit costs from previous bids.

COST AND BUDGET BREAKDOWN
We have included a Project Involvement and Budget Spreadsheet for each of the four landslides in the Appendix.

Site CSA Fees Direct Costs
(Outside)
Total Project
Budget
Adobe Drive $10,330 $70 $10,400
601 Talbot Avenue $10,330 $70 $10,400
1475 Rosita Road $23,070 $70 $23,140
Sharp Park $23,070 $4,670 $27,740

Total of all four sites: $71,680
We understand that there is remaining budget from our previous contract, which the City plans to carry over to this one.

SCHEDULE
We understand that the City plans to go out for bid in February of 2026, and we are confident that we can make that schedule, provided the City provides CSA with timely revisions to the drawings.

We anticipate that draft drawings for 1475 Rosita Road and Sharp Park can be prepared before February 2026, provided that we receive authorization to proceed prior to November 20, 2025; however, the Sharp Park schedule is dependent on the Structural Engineer’s schedule.

Please note that David Schrier has a vacation planned for 3 weeks in December 2025.

CITY OF PACIFICA

COUNCIL AGENDA SUMMARY REPORT
12/8/2025
1 SUBJECT:

Agreement with The San Francisco Peninsula for Management of Pacifica Tourism Marketing District (PTMD)
RECOMMENDED ACTION:

Adopt Resolution Authorizing the City Manager to execute the agreement with The San Francisco Peninsula for Management of Pacifica Tourism Marketing District (PTMD).

STAFF CONTACT:

Yulia Carter, Assistant City Manager
(650) 501-6004
[email protected]
BACKGROUND/DISCUSSION:

Pacifica’s lodging industry has participated in a formal tourism assessment district since 2004, when the Pacifica Hotel Business Improvement District (PHBID) was formed under the Parking and Business Improvement Area Law of 1989 (“’89 Law”). The PHBID established a $1-perroom-night assessment to fund marketing and promotion efforts for local hotels.

Over time, as industry best practices shifted statewide toward the Property and Business Improvement District Law of 1994 (“’94 Law”), the framework used by most modern Tourism Marketing Districts, Pacifica’s hotel operators expressed interest in transitioning to a more flexible and industry-governed model.

In early 2024, the City and lodging partners began exploring modernization of the district by forming a new Tourism Marketing District under the Property and Business Improvement District Law of 1994 (“’94 Law”). The ’94 Law provides a more flexible structure and enables assessment revenues to be directed to a nonprofit entity governed by the assessed businesses, an industry-standard approach widely used throughout California.

Following industry outreach, financial analysis, and the required statutory noticing and protest procedures, the Pacifica Tourism Marketing District (PTMD) was formally established on April 28, 2025, for a five-year term beginning July 1, 2025.

The PTMD includes all existing and future hotels and short-term vacation rentals within the city and levies a 0.5% assessment on gross room revenue, excluding stays over 30 days and federally exempt guests. The former PHBID expired on June 30, 2025, and PTMD operations and assessment collection commenced July 1, 2025.

Management and Administration
Under the ’94 Law, PTMD assessment revenues must be administered by a nonprofit organization responsible for implementing the Management District Plan (MDP). To select a 11 Packet Pg. 280
Pacifica City Council 2
December 08, 2025
qualified entity, the City issued a Request for Proposals (RFP) on June 3, 2025. Three proposals were received and evaluated based on demonstrated experience with tourism districts, regional marketing capacity, understanding of Pacifica’s visitor market, and ability to implement the MDP effectively. Based on the initial evaluation, only two out of three proposers, The San Francisco Peninsula (SFP), and Peninsula Chinese Business Association, were determined to be qualified under the ’94 Law and were invited to participate in interviews with the PTMD subcommittee.

Following the interview process, the PTMD Advisory Board recommended The San Francisco Peninsula (SFP) as the preferred contractor. In addition to its strong destination marketing capabilities, SFP currently manages the San Mateo County Tourism Business Improvement District, of which Pacifica hotels are already members. Aligning management of the local PTMD with the countywide BID enhances coordination, creates a unified marketing platform, and allows Pacifica to leverage existing regional campaigns, media relationships, and travel trade networks that already feature Pacifica properties.

Under the proposed contract, SFP will be responsible for implementing the MDP, including executing marketing campaigns, maintaining Pacifica’s tourism webpage, managing digital and print advertising, coordinating public relations, and supporting lodging partners through sales initiatives and regional partnerships.

The recommended contract will be for an initial one-year term based on the attached preliminary scope of work, which may be refined prior to the full execution of the contract. The agreement will include options to extend for up to two additional years based on performance and mutual agreement between SFP and the PTMD Advisory Board. The annual cost of $40,000 will be fully funded by PTMD assessments. Before the contract goes into effect, the District will also need to revamp the Visit Pacifica website to ensure it meets the technical and marketing capabilities required for SFP’s use. This work is currently underway and is expected to be completed in the next few weeks. Staff is requesting Council authorization for the City Manager, or his designee, to finalize and execute the contract with the SFP once website upgrade work is completed.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:

This item advances the Council’s goal of "Enhancing Organizational and Fiscal Sustainability" by strengthening the City’s tourism economy, supporting local businesses, and investing in economic development and marketing that will directly benefit the hospitality industry and improve the local economy.

FISCAL IMPACT:

There is no fiscal impact associated with this action. The City collects no fee for administering the district assessments at this time, and once it is transferred to the selected non-profit agency, the administration of the district will be fully covered by the assessments.

Section 10. CLOSED SESSIONS

1. Purpose.

It is the policy of the City Council to conduct its business in public to the greatest extent possible. However, the City Council recognizes that, in certain limited circumstances, public discussion jeopardizes the public interest, compromises the City’s position, and could cost the taxpayers of Pacifica a significant amount of money. Therefore, these rules provide for strict confidentiality of City Council discussion in certain circumstances allowed by law.

2. Rule of Confidentiality.

The City Council recognizes that breaches in confidentiality can severely prejudice the City’s position in litigation, labor relations and real estate negotiations. Further, breaches of confidentiality can create a climate of distrust among Councilmembers and can harm the Council’s ability to communicate openly in closed sessions, thereby impairing the Council’s ability to perform its official duties.

The City Council further recognizes that confidentiality of discussions and documents are at the core of a closed session. Confidentiality is essential if the closed session is to serve its purpose. Therefore, the City Council will adhere to a strict policy of confidentiality of closed sessions.

In accordance with the Brown Act, the City Council agenda will contain a brief general description of the items to be discussed at the closed session. City Councilmembers will keep all written materials and verbal information provided to them in closed session in complete confidence to ensure that the City’s position is not compromised.

No mention of information in these materials will be made to anyone other than Councilmembers, the City Attorney or City Manager, except where authorized by a majority of the City Council or otherwise required by law.

3. Breach of Confidentiality.

No person who attends a closed session may disclose any statements, discussions, documents or votes made in a closed session except where specifically authorized by these rules. Any authorized disclosure will be in strict compliance with these rules

4. Permissible Topics.

All closed sessions will be held in strict compliance with the Brown Act.

5. Scheduling Closed Sessions.

Subject to the advice of the City Attorney, a closed session may be called by the Mayor, by the City Attorney or by the City Manager.

6. Persons Permitted to Attend.

The City Council, City Manager and City Attorney, or their designees, may attend closed sessions unless it is necessary to excuse them for conflict of interest. Only such additional staff or attorneys shall attend as are necessary. The department head whose department is most directly affected by the topic of the closed session may also attend.

7. Rules of Decorum.

The same high standard of respect and decorum as applied to regular meetings shall apply to closed sessions. There shall be courtesy, respect and tolerance for all viewpoints and for the right of Councilmembers to disagree. Councilmembers shall strive to make each other feel comfortable that it is safe to express their points of view.

All Councilmembers have the right to insist upon strict adherence to this rule.

8. Penalties.

In addition to any penalties applicable under the Brown Act, violation of these confidentiality rules may be punishable by resolution of the Council censoring the person or persons responsible for the disclosure.
