BACKGROUND/DISCUSSION:
The Linda Mar Pump Station is a sanitary and stormwater sewage pump station located just off Linda Mar Beach, west of Cabrillo Highway near Linda Mar Boulevard.
On July 24, 2017, the City Council approved the Agreement for the Calera Creek Water Recycling Plant and Pump Stations Condition Assessment with Woodard & Curran. The Pump Stations Capital Improvement Plan Technical Memorandum outlined the recommended Capital Improvement projects for each of the City’s pump and lift stations including Linda Mar Pump Station. The Linda Mar Pump Station Upgrade Project is based on recommendations from the Technical Memorandum. Funding for the project was approved in Fund 34 (Now Fund 518) of the Wastewater Enterprise Fund for FY2020-2021 and FY2021-2022. The Linda Mar Pump Station Upgrade Project primarily focused on the existing motor control center (MCC), the programmable logic control (PLC) and automating the existing engine-driven pump. The existing equipment had reached the end of its useful life. Providing more modern electrical equipment and controls improves the reliability of pumping operations and reduce staffing needs for the pump station, especially during wet weather events.

The construction contract was awarded to Liffey Electric, Inc. (Liffey) on October 29, 2021. The initial contract value was $1,370,000, and eleven change orders were issued. With change orders the total cost of the contract with Liffey was $1,542,597.47. The Project is substantially complete as of the January 26, 2026, Council Meeting.
As the project is now complete and staff is satisfied with the contractor’s work on the project, it is appropriate to record the formal Notice of Completion with the San Mateo County Recorder's Office. This recorded document is the legal notice that the City considers the project complete and that we intend to pay the contractor for the full and complete contract price. This also puts all subcontractors and suppliers on notice that if they have any claims for payment from the contractor, they have 30 days to file claims for payment against the City. This provision of contract law protects subcontractors from contractors who may not pay them properly. It also protects the city from claims against the city for any nonpayment on the part of the contractor.
The City withheld 5% of the contract amount, $77,129.87, as retention to make sure that all subcontractors and suppliers have been paid. The City will release the retention if no claims are received.
The City Manager is recommending the adoption of the attached resolution accepting completion of the project and the filing of the Notice of Completion (Attachment 1) with the San Mateo County Recorder's Office.
At the time of bidding, a 10% contingency was estimated as needed for completion. Due to various issues during construction, including supply chain delays at the end of the COVID-19 pandemic and unforeseen complexity in the engine pump automation phase, a 13% contingency was needed to complete the project. The Table below summarizes the changes discussed in this report:
Item Cost
Original Agreement Value $1,370,000
Original Contingency $137,000
Revised Contingency $172,597
Total $1,542,597
Engineering services were required during construction. The City issued Task Order 2 for Engineering Services During Construction (ESDC) to Freyer and Laureta on September 13, 2021, for an amount not to exceed $128,600. As construction progressed, the project required a greater than anticipated level of effort associated with equipment and material resubmittals; responding to contractor requests for information; additional support for the automation of the engine drive pump automation. Challenges on the project continued, and $23,000 was required to complete the engineering portion of the project or a 28% contingency of the originally awarded fee.
Total Engineering Services During Construction
Linda Mar Pump Station Upgrade Project Engineering Services During Construction
$ 128,600
Contingency $ 12,860
Additional Services Required $ 23,000
Revised Contingency $ 35,860
Total $ 164,460

ALTERNATIVE ACTION:
Council may choose not to approve the Notice of Completion; however, this will result in unnecessary delay to the release of the retention funds for the contractor. Staff does not recommend this alternate action.
RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
Approval of the construction contract and supporting agreements is consistent with the following Council adopted Goals:
• Stewardship of City Infrastructure and Maintaining a Safe Community: This construction project will improve the reliability of Linda Mar Pump Station capacity and to mitigate potential impacts of flooding including threatening the safety of residents and damaging private property or critical public infrastructure.
FISCAL IMPACT:
While contingencies for Construction and ESDC were increased, the project is still within the funds originally allotted. Fiscal Impacts for the project are provided in the table below:

Total Source of Funds $ 2,015,000
