BACKGROUND/DISCUSSION:
On April 25, 2022, City Council authorized the City Manager to Award and Execute a Construction Agreement with W.E. Lyons for the Civic Center Campus Facilities Improvement Project. The project includes interior and exterior renovation of City Hall (170 Santa Maria Avenue) and Planning and Parks, Beaches and Recreation Building (1800 Francisco Boulevard), as well as site improvements to create a new Civic Center Campus for city staff and the public. The project was funded from numerous sources as shown in the Fiscal Impact section below.
There were 130 construction change orders issued to the contractor W.E. Lyons during the course of construction in the amount of $1,386,843.71 or 12.8% of the contract value. The change orders were design changes due to the condition of the existing building, weather delays, and bid item quantity adjustments. With the change orders and settlement agreement the final contractor construction cost for the project was $10,792,240.71.
As the project is now complete and staff is satisfied with the contractor’s work on the project, it is appropriate to record the formal Notice of Completion with the San Mateo County Recorder's Office. This recorded document is the legal notice that the City considers the project complete and that we intend to pay the contractor for the full and complete contract price. This also puts all subcontractors and suppliers on notice that if they have any claims for payment from the Pacifica City Council 2

contractor, they have 30 days to file claims for payment against the City. This provision of contract law protects subcontractors from contractors who may not pay them properly. It also protects the City from claims against the City for any nonpayment on the part of the contractor.
After many meetings and a lengthy negotiation, the City came to a settlement agreement with the contractor that was executed on 7/22/2025. As part of the settlement agreement the City has paid the 5% retention amount of $309,000.15.
The City Manager is recommending the adoption of the attached resolution accepting completion of the project and the filing of the Notice of Completion (Attachment 1) with the San Mateo County Recorder's Office.
