1 SUBJECT:

Pacifica Police Officers Association (PPOA) MOU Amendment for CalPERS Reporting Compliance
RECOMMENDED ACTION:

Adopt the Resolution Approving an Amendment to the Memorandum of Understanding (MOU) between the City of Pacifica and the Pacifica Police Officers Association for the period of July 1, 2025 through June 30, 2028, and clarifying Longevity Pay provisions in prior MOUs for the period of July 1, 2007 through June 30, 2012 for California Public Employee’s Retirement System (CalPERS) reporting compliance.

BACKGROUND/DISCUSSION:

The City and the Pacifica Police Officers Association (PPOA) reached agreement on a Memorandum of Understanding (MOU) for the period of July 1, 2025 through June 30, 2028, which was adopted by the City Council on July 14, 2025.

Recently, CalPERS conducted an audit and determined that language contained in previous MOUs related to longevity pay compensation did not clearly meet reporting requirements of CalPERS and the Public Employees’ Retirement Law (PERL). Specifically, MOUs covering the period of July 1, 2007 through June 30, 2012 referenced longevity pay as anniversary-based salary increases, which required clarification to ensure compliance with CalPERS reporting standards.

The proposed amendment revises Section 6.1 of the affected MOUs to clearly define longevity pay, including how it is earned, calculated on a compounded basis based on years of service, paid each pay period, and reported to CalPERS as pensionable special compensation (Attachments 1-3).

It is important to note that the amendment does not create new benefits or change in compensation but rather clarifies the language and aligns the contractual language with CalPERS reporting requirements. Adoption of the amendment will promote consistency with applicable law and reduce the risk of future pension reporting discrepancies.

ALTERNATIVE ACTION:

There is no reasonable alternative action. CalPERS has informed the City that the existing MOU language does not meet current reporting requirements and is therefore non-compliant.

Failure to adopt the proposed amendment would leave the City out of compliance, potentially resulting in inaccurate pension reporting and adverse impacts to employees’ future retirement benefit calculations.

In addition, continued non-compliance could subject the City to corrective action by CalPERS, including required retroactive reporting adjustments, administrative penalties, and potential financial liability associated with underreported or misreported compensation.

FISCAL IMPACT:

There is no direct fiscal Impact associated with adoption of this amendment, as it does not increase compensation or create new benefits, but simply clarifies existing language to ensure compliance with CalPERs reporting requirements.
