BACKGROUND/DISCUSSION:

The ADA provides civil rights protections to qualified individuals with disabilities in the areas of employment, public accommodations, State and Local Government Services, and telecommunications. Passed in 1990, the ADA is a companion civil rights legislation to the Civil Rights Act of 1964 and Section 504 of the Rehabilitation Act of 1973. Title II of the ADA requires public agencies to ensure their programs, services, and activities to individuals with disabilities.

This includes City-owned and operated facilities and infrastructure, public buildings, parks, parking lots, streets, sidewalks, curb ramps, and other elements within the public right-of-way.

The development of a transition plan is also a requirement of the federal regulations implementing the Rehabilitation Act of 1973, which requires that all organizations receiving federal funds make their programs available without discrimination toward people with disabilities.

The City of Pacifica completed an ADA Transition Plan in 1995. On November 22, 2021, City Council approved an Addendum No 1 to the 1995 ADA Transition Plan. The purpose of the ADA Transition Plan Update is to allow the City to conduct an updated inventory of all City facilities and right-of-way. The ADA Transition Plan acts as a guidance document for the City to continue to meet federal ADA standards and will address any City facilities and right-of-way that Pacifica City Council 2

are out of compliance to bring them up to current ADA standards. It serves as a long-term planning and budgeting tool to systematically address non-compliant conditions and to incorporate accessibility improvements into future capital improvement and maintenance projects.

Engineering Division Staff issued a Request for Proposal for the ADA Transition Plan Update. A total of thirty-six (36) consultant firms downloaded the project documents, and six (6) firms submitted proposals by the January 29, 2026 deadline:

1. Accessibility Consulting Partners, Inc

2. Bureau Veritas Technical Assessments, Inc

3. Disability Access Consultants, LLC

4. Independent Ergonomist DBA IHEALTH 360, LLC

5. Matrix Design Group, Inc

6. Sally Swanson Architects, Inc
Consultant proposal evaluations were conducted by staff from the Engineering Division. The proposals were scored based upon the consultants’ quality of proposal and responses to specific questions included in the RFP, experience of the proposer conducting similar work in California, relevant qualifications of key personnel assigned to this project, accessibility of key personnel to the City’s staff during the project, understanding of the City’s objectives, and reasonableness of fees and cost proposal.

Based upon the above criteria, Sally Swanson Architects, Inc. (SSA) was selected by staff to proceed with the ADA Transition Plan Update. The cost estimate for the project is $148,340.

Staff recommend including a 10% contingency of $14,834.50 for any additional or unforeseen work needed.

SSA has been creating accessible environments by pairing deep expertise in ADA compliance with strong, place-making design for over 46 years. Their firm has completed ADA Transition Plans services for public agencies including the San Mateo County Harbor District, City of San Pablo, City of Santa Clara, City of Porterville, and City of Winters. Their work with these agencies has included full accessibility evaluations of public buildings, parks, harbors, and rights-of-way, and coordination of community outreach and engagement with disability-serving organizations. SSA’s in-house Certified Access Specialists support all phases of this work, from field assessments and barrier identification to development of clear Transition Plan recommendations tailored to each agency’s needs.

ALTERNATIVE ACTION:

Council may choose not to authorize design of the ADA Transition Plan Update. However, this would delay staff’s ability to identify American Disabilities Act and Rehabilitation Act improvements that have not yet been completed. Staff does not recommend this alternate action.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:

Approval of these actions is consistent with the following Council adopted Goals:
• Improve and steward City Infrastructure, streets, and facilities: Approval of the ADA Transition Plan Update will improve the city’s accessibility FISCAL IMPACT:
