BACKGROUND/DISCUSSION:
On August 14, 2023, City Council authorized the City Manager to Award and Execute a Master Agreement for Consultant Services for Engineering Design of the Lower Linda Mar Sanitary Sewer Rehabilitation and Repair Project. The authorized project budget for Consultant and Design Services was $506,000.00 and utilized the Enterprise Fund (Fund 518) as its source.
On May 28, 2024, City Council authorized the City Manager to Award and Execute a Construction Agreement for the Lower Linda Mar Sanitary Sewer Rehabilitation and Repair Project. The project included replacing existing sewer mains with new pipes and rehabilitating manholes to improve system reliability and reduce the risks of sanitary sewer spills as well as inflow and infiltration (I&I). The project was financed through the California Infrastructure Bank $21 Million Installment Sale Agreement which was approved by Council on May 8, 2023. This Agreement financed wastewater system improvement projects including the Lower Linda Mar Sanitary Sewer Rehabilitation and Repair Project. The authorized project budget for construction and design services during construction was $11,748,689.05 and utilized the Enterprise Fund (Fund 518) as its source.
The combined authorized budget for consultant engineering design services and construction was $12,254,689.05.
There were thirteen construction change orders issued to the contractor Ranger Pipelines Pacifica City Council 2
March 09, 2026
during the course of construction in the amount of $1,619,710.25 or 16% or the contract value.
The change orders included additional scope to improve the overall Linda Mar neighborhood sewer system that has been problematic for the city. These added scope items include 4,256 LF of sewer main line, 105 lateral connections, and 17 manhole rehabilitations. There were also a few design changes due to existing condition conflicts, weather delays, and bid item quantity adjustments. With the change orders final contractor construction cost for the project was $10,097,725.25.
As the project is now complete and staff is satisfied with the contractor’s work on the project, it is appropriate to record the formal Notice of Completion with the San Mateo County Recorder's Office. This recorded document is the legal notice that the City considers the project complete and that we intend to pay the contractor for the full and complete contract price. This also puts all subcontractors and suppliers on notice that if they have any claims for payment from the contractor, they have 30 days to file claims for payment against the City. This provision of contract law protects subcontractors from contractors who may not pay them properly. It also protects the City from claims against us for any nonpayment on the part of the contractor. The City withheld 5% of the contract amount, $504,886.26, as retention to make sure that all subcontractors and suppliers have been paid. The City will release the retention if no claims are received.
The City Manager is recommending the adoption of the attached resolution accepting completion of the project and the filing of the Notice of Completion (Attachment 1) with the San Mateo County Recorder's Office.
