BACKGROUND/DISCUSSION:
On August 5, 2025, Public Works Wastewater Division staff received a call from a resident observing a potential leak at the 6-inch sewer main crossing Calera Creek between Oneonta Avenue and Reina del Mar Avenue. Staff observed a crack in the pipeline. While no leaking was observed, there is potential for leakage during wet weather flows. The potential for a sewer main failure and resulting sanitary sewer overflows threatens the health and safety of persons and property, including critical public infrastructure. This sewer main had been identified for replacement as part of the Vallemar and Rockaway Beach Boulevard Areas Sewer and Rehabilitation and Repair Project, and the design (approved by Council August 26, 2024) was in progress. Due to this finding, this pipeline crossing Calera Creek needed to be repaired or replaced immediately.
The City of Pacifica’s Emergency Plan and Section 4-2.01 et seq. of the Pacifica Municipal Code empower the City Manager, acting as the Director of Emergency Services, to proclaim the existence of a local emergency when there is an actual or threatened existence of conditions of disaster or of extreme peril to the safety of persons and properties within this City. The Proclamation of Local Emergency for the Vallemar Sewer Main Crossing was ratified on August 25, 2025. The situation resulting from the emergency conditions was deemed to be within the Pacifica City Council 2

control of the normal protective services, personnel, equipment, and facilities of and within Pacifica. The City Manager, as Director of Emergency Services, and staff now recommend the City Council approve a Resolution of termination of the local emergency at the sewer main creek crossings in the Vallemar neighborhood.
On August 26, 2025, the City directed Freyer & Laureta, Inc. to proceed with Project Design, Consultant Services for Engineering Design During Construction of the Vallemar Phase II Emergency Sanitary Sewer Rehabilitation and Repair Project. The authorized project budget for Consultant and Design Services was $94,500.00 and utilized the Enterprise Fund (Fund 518) as its source.
The construction agreement was awarded to Ranger Pipelines on November 14, 2025. The initial agreement value was $1,178,590.00 and one change order was issued. With change orders and bid item quantity adjustments the Final Total Cost of the contract with Ranger Pipelines was $1,194,525.00. The Project was substantially complete as of March 18, 2026.
The project is now complete and staff is satisfied with the contractor’s work on the project, it is appropriate to record the formal Notice of Completion with the San Mateo County Recorder's Office. This recorded document is the legal notice that the City considers the project complete and that we intend to pay the contractor for the full and complete contract price. This also puts all subcontractors and suppliers on notice that if they have any claims for payment from the contractor, they have 30 days to file claims for payment against the City. This provision of contract law protects subcontractors from contractors who may not pay them properly. It also protects the City from claims against us for any nonpayment on the part of the contractor. The City withheld 5% of the contract amount, $59,726.25, as retention to make sure that all subcontractors and suppliers have been paid. The City will release the retention if no claims are received.
The City Manager is recommending the adoption of the attached resolution accepting completion of the project and the filing of the Notice of Completion (Attachment 1) with the San Mateo County Recorder's Office.
