BACKGROUND/DISCUSSION:
The City and PSLAC entered into the original Jean E. Brink Pool License Agreement effective July 1, 2021 for the use of the Jean E. Brink Pool located at Oceana High School. The agreement provides PSLAC with a non-exclusive license to utilize the facility for swim team practices, competitions, and related activities.
The agreement established operational requirements, maintenance responsibilities, insurance requirements, and monthly license fees associated with PSLAC’s use of the facility. The current agreement term expires on June 30, 2026.
City staff and PSLAC have discussed extending the current agreement on a short-term basis while the City continues evaluating future aquatics facility operations, partnership opportunities, and long-term agreement structures.
The proposed First Amendment would amend Section 4 (Term) of the original agreement to extend the expiration date from June 30, 2026 to December 31, 2026.
Additionally, the amendment would revise Section 5.1 (Monthly Rate) to establish a new monthly fee of $5,552.84 per month for the six-month extension period. The total amount payable during the extension period would be $33,317.05.
The proposed rate adjustment is intended to more closely align with the City’s direct operational costs associated with hosting PSLAC programming at the Jean E. Brink Pool, including staffing, maintenance, utilities, and facility operations.
The proposed extension allows PSLAC to continue uninterrupted operations at the Jean E.
Brink Pool while providing the City additional time to evaluate long-term aquatics facility operational and partnership considerations.

June 22, 2026
All other provisions of the original agreement would remain in full force and effect.
ALTERNATIVE ACTION:
The City Council may choose not to approve the proposed First Amendment to the Jean E.
Brink Pool License Agreement. If the amendment is not approved, the existing agreement would expire on June 30, 2026, and PSLAC would no longer have authorization to utilize the Jean E.
Brink Pool facility under the current agreement structure. This could result in interruption or suspension of PSLAC programming and would require the City and PSLAC to negotiate a different agreement structure or discontinue use of the facility.
RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
Approval of this item supports the City Council’s goal of fostering a healthy and compassionate community by continuing to provide residents with access to a competitive swim team.
FISCAL IMPACT:
Approval of the proposed First Amendment would generate $33,317.05 in license fee revenue to the City during the six-month extension period from July 1, 2026 through December 31, 2026.
Revenue would be deposited into the Parks, Beaches and Recreation Department Aquatics budget.
The revised fee structure is intended to offset the City’s direct operational and facility-related costs associated with the agreement.
