THE PACIFICA SEA LIONS AQUATICS CLUB AND THE CITY OF PACIFICA This First Amendment to the Jean E. Brink Pool License Agreement between the Pacifica Sea Lions Aquatics Club and the City of Pacifica (“First Amendment”) is entered into as of June 22, 2026 (“Effective Date”) by and between the CITY OF PACIFICA, herein called the “City,” and the Pacifica Sea Lions Aquatic Club, a 501 (c)(3) organization, herein called the “PSLAC.” The City and PSLAC shall be referred to individually as “PSLAC” or “City” or collectively as “Parties.”
I. RECITALS
A. City and PSLAC entered into a License Agreement on July 1, 2021 for the use of the Jean E. Brink Pool located on the campus of Oceana High School at 401 Paloma Avenue, Pacifica California (“Original Agreement”).
B. The Original Agreement is set to expire on June 30, 2026 and the Parties desire to extend the term of the Original Agreement for an additional six months to December 31, 2026.
C. The Parties also desire to revise the fee to $5,552.84 per month, for a total amount of $33,317.05 to be paid during the period from July 1, 2026 to December 31, 2026.
II. AGREEMENT
NOW, THEREFORE, based on and in consideration of the mutual promises and agreements contained herein and the recitals set forth above and incorporated in this First Amendment, and for other good and valuable consideration the receipt and sufficiency of which are hereby acknowledged, the Parties agree as follows:
1. Amendments to Original Agreement.
A. Section 4, Term, shall be amended to read as follows:
“4. Term. Subject to the terms and conditions of this Agreement, the License granted pursuant to Section 2 above shall commence on the Effective Date and shall continue until and expire on the date which is December 31, 2026 (the “Termination Date”), unless terminated prior to the Termination Date in accordance with Section 6.” B. Section 5.1. Monthly Rate, within Section 5, Fees, shall be amended to read as follows:
“5.1 Monthly Rate. PSLAC shall pay the City $5,552.84 per month (“Base Monthly Rate”).”
2. Agreement in Effect. All other provisions of the Original Agreement, as amended, shall remain in full force and effect.
