A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PACIFICA AUTHORIZING THE
CITY MANAGER TO EXECUTE A TO A CONSULTANT SERVICES AGREEMENT WITH THE
HOUSING ENDOWMENT AND REGIONAL TRUST OF SAN MATEO COUNTY (HEART) FOR
HOUSING RELATED SERVICES
______________________________________________________________________ WHEREAS, the Housing Endowment and Regional Trust of San Mateo County, known as HEART, is a Joint Powers Authority (“JPA”) established by the County and cities and towns within the County (“Member Agencies”) via the Joint Exercise of Powers Agreement dated May 13, 2003, as amended and superseded by the First Amended Joint Exercise of Powers Agreement dated September 9, 2008; and
WHEREAS, the City and other Member Agencies identified a need for professionals to carry out new housing programs and efforts required by newly adopted housing elements; and WHEREAS, City staff waived the bid procedures and signed a sole source agreement with HEART on January 8, 2024, for housing related services; and WHERAS, the First Amendment to the JPA Agreement Authorizes heart to facilitate and assist member agencies to operate regulate maintain and facilitate the planning and study of appropriate housing programs, projects and housing management projects; and WHEREAS, the City as a member agency engaged HEART to utilize their services to obtain assistance carrying out its housing programs by adopting Resolution No. 04-2024 on January 8, 2024, approving a consultant services agreement for housing related activities and assignments and related services through June 30, 2026 (“Original Agreement”), and authorizing the City Manager to execute the Agreement; and
WHEREAS, a First Amendment to the Original Agreement was signed on July 1, 2025, to increase the cost ceiling by 5 percent and, per the original Agreement, expires on June 30, 2026; and
WHEREAS, the City wishes to enter into a new agreement under the sole source exemption that provides a new scope of services and a new term of contract and replaces the Agreement and First Amendment; and
WHEREAS, the City Council of the City of Pacifica has considered the City Manager’s recommendation to approve an Agreement for Consultant Services with HEART for housing related consultant services on June 22, 2026.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Pacifica to authorize the City Manager, following adoption of the Fiscal Year 2026-2027 budget, to enter into an Agreement for Consulting Services with HEART for housing related services, not to exceed $160,000 over the fiscal years 2026-2027, 2027-2028, and 2028-2029, with a term of the agreement to June 30, 2029.
