BACKGROUND/DISCUSSION:
On June 22, 2023, during the FY 2023-24 Capital Improvements Program (CIP) budget approval process, the Council approved funding for the CCWRP Admin Building Elevator Assessment Project. This Project was created to assess the current condition of the building elevator and determine the best improvements for modernization. The Project has been renamed to CCWRP Admin Building Elevator Modernization Project.
On August 11th, 2025, City Council authorized the City Manager to Award and Execute a Construction Agreement for the CCWRP Admin Building Elevator Assessment Project. The project included replacing electrical fixtures, fire life safety upgrades, and replacing the hydraulic power unit. The project was financed through the Enterprise Fund (Fund 518 Sewer Utility).
In addition to KONE’s contracted work, the City was able to utilize the project funds to replace damaged flooring in the cab interior which would have failed state inspection, install a required emergency fire key box for the Calera Creek Water Recycling Plant, and have a standby technician for the electrical shutdown to test running the elevator system on emergency power.
As the project is now complete and staff is satisfied with the contractor’s work on the project as well as passing the state and building inspection, it is appropriate to record the formal Notice of Completion with the San Mateo County Recorder's Office. This recorded document is the legal notice that the City considers the project complete and that we intend to pay the contractor for the full and complete contract price. This also puts all subcontractors and suppliers on notice that if they have any claims for payment from the contractor, they have 30 days to file claims for Pacifica City Council 2

payment against the City. This provision of contract law protects subcontractors from contractors who may not pay them properly. It also protects the City from claims against us for any nonpayment on the part of the contractor. The City withheld 10% of the contract amount, $20,530, as retention to make sure that all subcontractors and suppliers have been paid. The City will release the retention if no claims are received.
The City Manager is recommending the adoption of the attached resolution accepting completion of the project and the filing of the Notice of Completion (Attachment 1) with the San Mateo County Recorder's Office.
FISCAL IMPACT:
There is no fiscal impact associated with the filing of the Notice of Completion. The total project Source and Use of Funds table is shown below. The project balance will remain in Fund 518- Enterprise Fund.
Total Project Source and Use of Funds
Enterprise Fund (Fund 518) $219,000
Total Source of Funds $219,000
Construction Actual Cost - KONE Inc. $209,467.84
Total Use of Funds $209,467.84
Project Fund End Balance $9,532.16
ALTERNATIVE ACTION:
Council may choose not to adopt the resolution accepting completion of the project, but as the work has been satisfactorily completed, the contractor may file a claim against the City for nonpayment of retention, if there are no claims.
RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
Approval of the Notice of Completion for the Calera Creek Water Recycling Plant Admin Building Elevator Modernization Project is consistent with the following Council adopted Goals:
• Stewardship of City Infrastructure: includes repairing/replacing outdated city facilities such as infrastructure, city hall, the libraries, fire stations, etc., improving streets, and responding to impacts of sea level rise. This construction project will improve the existing wastewater treatment facility through the upgrade of the elevator system located inside the admin building.
