BACKGROUND/DISCUSSION:

On August 23, 2022, City Council authorized the City Manager to Award and Execute a Master Agreement for Consultant Services for Engineering Design of the Ultraviolet Disinfection System Replacement Project. The authorized project budget for Consultant and Design Services was $920,000.00 and utilized the Enterprise Fund (Fund 518) as its source.

On May 28, 2024, City Council authorized the City Manager to Award and Execute a Construction Agreement for the Ultraviolet Disinfection System Replacement Project. The project included replacing the existing single channel ultraviolet disinfection system with an upgraded dual channel system to improve energy efficiency and operation and maintenance issues. The project was financed through the California Infrastructure Bank $21 Million Installment Sale Agreement which was approved by Council on May 8, 2023. This Agreement financed wastewater system improvement projects including the Ultraviolet Disinfection System Replacement Project. The equipment cost of $1,1250,264.13 from Trojan Technologies was transferred to Anvil Builders Inc. after the award of bid and paid under Anvil Builder’s Inc.’s total cost. The authorized project budget for construction and design services during construction was $8,815,573.80 and utilized the Enterprise Fund (Fund 518) as its source.

The combined authorized budget for consultant engineering design services and construction was $9,768,696.

There were seven construction change orders issued to the contractor Anvil Builders Inc. during the course of construction in the amount of $91,577.25 or 1.59% or the contract value. The change orders included scope to demolish additional concrete and repair portions of the original channel. There was also added scope to integrate ultraviolet system electronics with supervisory control and data acquisition (SCADA) tags during a concurrent plantwide SCADA upgrade to facilitate operational controls. There were also a few changes removing some unneeded scope and equipment costs. With the change orders final contractor construction cost Pacifica City Council 2
July 13, 2026
for the project was $5,859,203.

As the project is now complete and staff is satisfied with the contractor’s work on the project, it is appropriate to record the formal Notice of Completion with the San Mateo County Recorder's Office. This recorded document is the legal notice that the City considers the project complete and that we intend to pay the contractor for the full and complete contract price. This also puts all subcontractors and suppliers on notice that if they have any claims for payment from the contractor, they have 30 days to file claims for payment against the City. This provision of contract law protects subcontractors from contractors who may not pay them properly. It also protects the City from claims against us for any nonpayment on the part of the contractor. The City withheld 5% of the contract amount, $488,435.79, as retention to make sure that all subcontractors and suppliers have been paid. The City will release the retention if no claims are received.

The City Manager is recommending the adoption of the attached resolution accepting completion of the project and the filing of the Notice of Completion (Attachment 1) with the San Mateo County Recorder's Office.

FISCAL IMPACT:

There is no fiscal impact associated with the filing of the Notice of Completion. The total project Source and Use of Funds table is shown below. The project balance will remain in Fund 518- Enterprise Fund. We plan to utilize the project fund balance to complete operational startup and project close out with the design team including; sampling, testing, and reporting analysis. The construction work under the contractor's scope of services has been completed, and staff is requesting authorization to file a Notice of Completion. Separate work related to project design and post-construction services remains ongoing under the design consultant's (Carollo Engineer's) agreement and is not part of the contractor's scope of work.
