BACKGROUND/DISCUSSION:
The City entered into an agreement with the California Infrastructure and Economic Development Bank (IBank) for funding May 9, 2023, and this Installment Sales Agreement (ISA) was used to finance the recently completed Lower Linda Mar Rehabilitation and Repair Project and the UV Disinfection System Replacement Project in the amount of approximately $20.6 million. At the same time, the City also identified the U.S. Environmental Protection Agency’s (USEPA) Water Infrastructure Financing and Innovation Act (WIFIA) Program for the Collection System Rehabilitation & Replacement Projects: Vallemar and Rockaway Beach Avenue. The City submitted a Letter of Interest (LOI) to the WIFIA Program on June 27, 2024, and was invited to apply to the program on July 22, 2024. The City approved a resolution to apply for the WIFIA program on August 25, 2025, and will bring the loan agreement to Council when finalized (anticipated 2026 Q4).
Task Orders 1 and 2 with Luhdorff & Scalmanini Consulting Engineers (LSCE) included funding support to complete the WIFIA, LOI, loan application, and development of the loan agreement.
LSCE supported the City’s IBank ISA development, approval and servicing of the loan agreement. Thus, LSCE has unique experience in providing funding support for the Wastewater Division’s Capital Improvements Program (CIP) and experience. Due to LSCE’s institutional knowledge of the WIFIA program and the Wastewater Division’s CIP, staff recommend sole sourcing LSCE for CIP funding support services per Administrative Policy #76, Section 7.4. If the City does not enter the WIFIA loan agreement with the USEPA, the City will discontinue work under this agreement.

LSCE’s work under Task Order 3 during the WIFIA loan development and implementation periods will include coordinating with the City and the USEPA to establish the funding agreement and terms. Once the loan is implemented and the Collection System Rehabilitation & Replacement Projects: Vallemar and Rockaway Beach Avenue project is under construction, LSCE will work with the City to process monthly disbursements for project work. This will ensure a steady cashflow during project delivery. LSCE will produce the final project report and checklist items to close out the project with the USEPA as construction is completed. The breakdown of Task Order #3 is as follows:
• Task 1 - Project Management
• Task 2 - WIFIA Loan Support - Through WIFIA Agreement Execution • Task 3 - WIFIA Loan Support - Monthly Reimbursement Processing • Task 4 - WIFIA Loan Agreement - Project Completion Report • Task 5 - WIFIA Loan Support - Final Check List Items
ALTERNATIVE ACTION:
The Council may choose not to adopt the Resolution approving Task Order 3, however this may delay the award and servicing of the WIFIA loan once awarded.
RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
Adoption of the Resolution is consistent the these adopted City Goals:
• Stewardship of City Infrastructure and Maintaining a Safe Community: Adoption of the Resolution is the first step to ensuring sufficient funding for the Collection System Rehabilitation & Replacement Projects: Vallemar and Rockaway Beach Avenue. • Enhancing Organizational and Fiscal Sustainability: The adoption of the Resolution will allow for securing funding with the USEPA sooner, as construction costs continue to escalate.
