CITY OF PACIFICA

COUNCIL AGENDA SUMMARY REPORT
8/24/2026
1 SUBJECT:

Authorize the acceptance of $31,222.27 from the State of California’s Cannabis Tax Fund Grant Program, and authorizing execution of the related grant agreement with the California Highway Patrol, for the education, prevention, and enforcement of impaired driving laws.

RECOMMENDED ACTION:

Adopt a resolution of the City Council of the City of Pacifica authorizing the acceptance of $31,222.27 from the State of California’s Cannabis Tax Fund Grant Program, and authorizing execution of the related grant agreement with the California Highway Patrol, for the education, prevention, and enforcement of impaired driving laws.

BACKGROUND:

With the passage of Proposition 64 in 2016, the Control, Regulate and Tax Adult Use of Marijuana Act (AUMA), California voters mandated the state to set aside funding for the CHP to provide grants to local governments and Qualified Nonprofit Organizations for the education, prevention, and enforcement of impaired driving laws pursuant to Section 34019 (f)(3)(B) Revenue and Taxation Code (RTC).

The Cannabis Tax Fund Grant Program funding for fiscal year 2026/2027 is $13,000,000.00 for the education, prevention, and the enforcement of laws related to driving under the influence of alcohol and other drugs, including cannabis and cannabis products.

The intent of the program is to educate the public regarding the dangers of impaired driving, enforce impaired driving laws on the roadway, and improve the Pacifica Police Department’s effectiveness through training and development of new strategies.

DISCUSSION:

In 2024 and 2025, 308 traffic collisions occurred in Pacifica. Of those, 125, or approximately 40%, resulted in injuries. When the data was evaluated, approximately 20% of all reported collisions were determined to have been caused by impaired driving.

In 2024 and 2025, the Pacifica Police Department made approximately 161 arrests for driving while impaired. Of these, 60 DUI/DUI Drug arrests involved a traffic collision in which driving while impaired was identified as the primary contributing factor.

Due to low staffing levels and budgetary constraints, the police department does not have the capacity to staff a specialized traffic unit. Any special enforcement operation or public education presentation requires personnel to work overtime which is both costly and unsustainable. This grant award will enable the police department to fund six DUI/DUI Drug saturation patrols and one DUI/DUI Drug checkpoint, and to purchase high-visibility traffic vests, flashlights, and pen lights for drug recognition evaluators to be used during DUI/DUI Drug checkpoints and enforcement details.

Staff submitted a grant application requesting funding and received an award totaling $31,222.27 under grant award number 30954. The grant performance period runs from July 1, 2026 through June 30, 2027. The request included personnel costs for special enforcement and saturation patrols, and funding for high-visibility traffic vests, flashlights, and pen lights for drug recognition evaluators. The application also requested two mobile identification devices, which were not included in the final award.

ALTERNATIVE ACTION:

Council may choose not to adopt the resolution. However, not doing so will result in the City forfeiting this award of $31,222.27 for impaired driving education and enforcement.

RELATION TO CITY COUNCIL STRATEGIC GOAL 1:
• Enhance organizational and fiscal stability: Adopting the resolution will support the strategic initiative to pursue grant funding.

FISCAL IMPACT:

Acceptance of the grant will provide $31,222.27 in Cannabis Tax Fund Grant Program revenue to the Police Department for the grant performance period of July 1, 2026 through June 30, 2027. The grant requires no local cash match. Funds are disbursed by the California Highway Patrol on a reimbursement basis following quarterly reporting, and under the terms of the grant agreement the City is responsible for any project costs that exceed the awarded amount. Grant revenue and the corresponding expenditures will be appropriated in the Police Department budget as shown in the detailed budget estimate below. There is no anticipated impact to the General Fund.
