SUBJEC
T: FINDINGS TO CONDUCT CITY COUNCIL AND BOARD, COMMISS ION, AND COMMITTEE MEETINGS VIRTUALLY UNDER ASSEMBLY BILL 361 FRO
M: Teresa Gallavan, Interim City Manager
BY: Brend
a Pree, City Clerk
RECOMMENDATION:

Find th
at the City Council has considered the circumstances of the state of emergency during a proclaimed state of emergency, and state or local officials have imposed or recommended measures to promote social distancing, and as a result, the Palm Springs City Council and all of Palm Springs Board, C ommission, and Committee meetings may be held by videoconference, in accordance with AB 361.

BACKGROUND:

Gover
nor Newsom’s Executive Orders N-29-20 and N-35-20, which relaxed some of the Brown Act’s teleconferencing provisions during the COVID -19 pandemic, expired on September 30, 2021. On September 16, 2021, Governor Newsom signed AB 361, which amends sections of the Brown Act to allow legislative bodies to more easily hold teleconference meetings during a state of emergency.

In ord
er to utilize these provisions of the Brown Act, the City Council must find that it has considered the circumstances of the state of emergency, and either:
(1) stat
e or local officials have imposed or recommended measures to promote social distancing as a result of the proclaimed state of emergency, or
(2) the state of emergency continues to directly impact the ability of the members to meet safely in person.

The Ci
ty Council must make these findings every 30 days for as long as the City is conducting virtual meetings under AB 361.

City St
aff and the City Attorney’s Office believe that these findings can be made. Although the Governor’s Executive Orders dealing with virtual meetings have expired, the original state of emergency for COVID -19 is still in effect. In addition, the California Department of Public Health (CDPH) and the County of Riverside continue to recommend social distancing as a result of the COVID-19 state of emergency.

Item 1A - Page 1
City Council Staff Report

Virtual Meetings Under AB 361

As such, City S taff and the City Attorney recommend that t he City Council make these findings, including at every Council meeting, in order to meet the “every 30 days ” requirement of AB 361. These findings would apply to all City Boards, Commissions and Committees, so they are able to hold virtual meetings under AB 361.

FISCAL IMPACT:

There is no fiscal impact associated with this action.

CITY COUNCIL STAFF REPORT

DATE: DECEMBER 15, 2022 CONSENT CALENDAR

SUBJECT: REJECT ALL BIDS FOR THE AIRPORT COMMON USE PODIUMS – BONO CONCOURSE, CITY PROJECT NO. 21-28

FROM: Teresa Gallavan, Interim City Manager

BY: Engineering Services Department

SUMMARY:

This action will reject all bids received on November 15, 2022 and authorize Staff to advertise the rebid of the project.

RECOMMENDATION:

1. Reject the bid received on November 15, 2022 for Airport Common Use Podiums – Bono Concourse, City Project No. 21-28 (the “Project”); and

2. Authorize Staff to rebid the Project.

BACKGROUND:

On March 9, 2022, the City received proposals for the design of the P roject which will replace the boarding gate podiums at the Bono Concourse at the Palm Springs International Airport. The scope of work will also include the replacement of the carpet and customer service counters. The proposed changes will help provide more space for passenger seating and queuing at the Bono Concourse and allow any airline to operate from any gate within the concourse.

On April 19, 2022, the City selected Gensler as the firm most qualified to prepare the construction documents for this Project.

The City and Gensler have been conducting design development meetings to incorporate feedback from the A irlines and A irport Staff. The common use podiums are being designed to accommodate IT system equipment that all airlines will use at the boarding gates. New digital Gate Information Displays (GIDS) will be added to each gate, signage will be updated, and gate queuing layout options were reviewed.

Item 1D - Page 1
The Bono Concourse will remain operational during construction and the construction documents are set up to phase the work so that gate closures can be coordinated throughout the Project.

On September 29, 2022, the City Council approved the plans, specifications, and authorized Staff to advertise and solicit bids for the Project.

STAFF ANALYSIS:

Staff advertised the Project on October 18, 2022, to prospective bidders. On November 15, 2022, the Engineering Services Department received one bid from CALTEC Corp. of Westminster, CA, in the amount of $1,400,000. The Engineer’s estimate for the project was $1,340,000. Given the bid was higher than expected and no comparable bids were received from any other contractor, Staff will evaluate the bid specifications and adjust as necessary to encourage more bidders.

Airport Staff continues to meet with the various airlines in anticipation of this project. A s record numbers of passengers have been coming through the A irport, and considering the operational needs of the airlines, some design changes are being recommended to improve customer service at the Bono Concourse. This will include adding additional customer service podiums away from the gate doors.

Staff recommends that the City reject all bids, incorporate design changes into the bid package, and readvertise the Project after the holidays in hopes of attracting more bidders.

ENVIRONMENTAL ASSESSMENT
:

In accordance with the California Environmental Quality Act (“CEQA”) Guidelines Section 15301 “Existing Facilities”, Class 1 projects consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public structures, facilities, mechanical equipment, or topographical features involving negligible or no expansion of existing or former use. Therefore, Staff has determined that the Airport Common Use Podiums – Bono Concourse, City Project No. 21- 28, is considered categorically exempt from CEQA.

ALIGNMENT WITH STRATEGIC PLANNING:

This project aligns with City Council Priority 3A – Improve City Facilities and will assist in implementing the strategic planning task to Prioritize Deferred Maintenance.

FISCAL IMPACT
:

None.
