CITY COUNCIL STAFF REPORT
DATE: JUNE 27, 2024 PUBLIC HEARING
SUBJECT: RESOLUTION CONFIRMING THE REPORT OF THE PALM SPRINGS
SMALL HOTEL TOURISM BUSINESS IMPROVEMENT DISTRICT
ADVISORY BOARD, LEVYING THE FISCAL YEAR 2024-25
ASSESSMENT, AND CONDUCT OF PROTEST PROCEEDINGS
FROM: Scott C. Stiles, City Manager
BY: Department of Finance and Treasury
SUMMARY:
The Palm Springs Small Hotel Tourism Business Improvement District (TBID) was formed in November 2016. On June 17, 2024, the City Council adopted Resolution N o. 25218, declaring its intention to renew the Palm Springs Small Hotel Tourism Business Improvement District, and setting the public hearing to June 27, 2024.
The City Council will conduct protest proceedings, consider renewing the TBID and a resolution confirming the report of the TBID Advisory Board and levying the Fiscal Year 2024-25 assessment.
RECOMMENDATION:
1) Open the public hearing, receive public testimony, and written and oral protests to confirm the Report of the Palm Springs Tourism Small Hotel Business Improvement District Advisory Board and levying an assessment for Fiscal Year 2024-25.
2) Adopt a Resolution entitled, “A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM SPRINGS, CALIFORNIA, CONFIRMING THE REPORT OF THE
PALM SPRINGS TOURISM SMALL HOTEL BUSINESS IMPROVEMENT
DISTRICT ADVISORY BOARD AND LEVYING AN ASSESSMENT FOR FISCAL YEAR 2024-25 IN CONNECTION WITH THE PALM SPRINGS TOURISM SMALL HOTEL BUSINESS IMPROVEMENT DISTRICT.”
BACKGROUND:
The Palm Springs Small Hotel Tourism Business Improvement District (TBID) was formed Item 2A - Page 1
City Council Staff Report
June 27, 2024 -- Page 2
Small Hotel Tourism Business Improvement District Renewal
in November 2016. On June 1 7, 2024, the City Council adopted Resolution No. 25218 declaring its intention to renew the Palm Springs Small Hotel Tourism Business Improvement District (TBID) and setting the public hearing for June 27, 2024.
A TBID is a special benefit assessment district that was established by the City Council, under existing State law
1, for the specific purpose of funding activities that promote tourism. This mechanism is also in place on larger hotels with an assessment to fund the Greater Palm Springs Convention and Visitor Bureau (GPSCVB). The renewal of this district would have no effect on the current GPSCVB assessment.
The law provides that business operators are assessed and pay the assessment to the City. Cities have utilized a percentage multiplied against daily hotel revenue as the formula for imposing the assessment. Further, this law provides cities have the express authority to make improvements and engage in business promotional activities that benefit the assessed businesses within the designated boundary area.
It is noted that the assessment is made against the business operator, and not against the property itself. Therefore, the assessment is legally treated by ordinance enactment as a debt owed by the business operator to the City. The City Attorney advises that Proposition 218 rules are not applicable because the assessment is not a tax on real property, and case law has clearly held that this enabling law (Streets and Highways Code sections 36500 et seq.) is not subject to Proposition 218 restrictions. ( Howard Jarvis
Taxpayers Assn. v. City of San Diego (1999) 72 Cal. App. 4th 230)
The renewal of the district is not by election of the business operators, but by majority protest procedure. After notice, any person subject to the proposed assessment may protest the renewal of the TBID. Each protest is weighted by the amount of the assessment to be paid. The TBID cannot be renewed if a majority of the affected businesses subject to the TBID, weighted by assessment, file a timely protest. Therefore, in order for a protest to be successful, businesses representing greater than 50% of the value of the total assessment to be collected must protest the formation of the district.
The TBID Advisory Board is recommending a 1% assessment on room revenue. The boundaries of the district would be citywide, but the assessments would be limited to hotels of 49 or less ( see Attachment B for the Advisory Board Fiscal Year 2024- 25 annual report).
The assessment would be collected by the City. The TBID Advisory Board is recommending the Palm Springs Bureau of Tourism (PSBOT) continue to administer the TBID funds and promotional programs as a segregated and restricted fund.
There are approximately 81 small hotels in Palm Springs with 49 rooms or less, and the small hotels believe they are at a marketing disadvantage because they do not have the same marketing infrastructure of larger, branded hotels. Most small hotels do not have Item 2A - Page 2

international marketing budgets, global call centers, local and national sales forces, international reservation systems, global brand recognition, etc.
ALIGNMENT WITH STRATEGIC PLANNING:
This item aligns with City Council Strategic Priority 1 , Quality of Life, s pecifically 1D, Economic Development.
FISCAL IMPACT:
Based upon the current assessment information, the assessment will generate approximately $850,000 in FY 2024-25. This revenue is restricted to use for the specific purpose of advancing the TBID’s interests.
The City incurred costs in establishing the TBID in Fiscal Year 2017-18 and will continue to incur costs in annually sustaining the TBID. These annual costs include mailings, hearings, notifications, related staff and research time. TBID administration includes collection, distribution, and auditing of the assessment, annual report preparation, and staff time. All administrative staff time and costs are reimbursed from the proceeds of the assessment.
The Director of Finance estimates the administrative cost to process monthly assessment returns and payments, collection of monthly assessment returns, annual administrative costs to prepare the notices, and conducting the public hearing to renew the TBID is approximately $50,000 for FY 2024- 25. All administrative staff time and costs are reimbursed from the proceeds of the assessment.

FY25 Adjusted Continuation Budget
• Total operating expenses increased by 8.5%, or $14.2 million from FY23.
Increases driven largely by the following:
o Salary and benefits increased by $5.2 million.
o Transfers to other funds include the $13 million funding to assist the Plaza Theatre Foundation in the restoration of the Plaza Theatre. The Foundation has committed to repay $10 million.
o Grant expenditures have increased by approximately $12 million over FY23. This is largely due to the state Home key grant of $16 million to fund the construction of the Navigation Center.
o Fire Department expenses include Tropical Storm Hilary damage totaling $989,000. This was primarily due to emergency repairs done to Indian Canyon, which will be reimbursed from the State in a future period.
• The Salary and Benefits graph below (Chart 3) depicts the personnel costs from FY22 through the FY25 Revised Budget for the General Fund. Costs have increased approximately $21 million, or 30%. Allocated positions were 506 in the FY22 budget and have increased to 657 in the FY25 Revised Budget.

Measure “J” was passed by the residents of Palm Springs on November 8, 2011, with an effective date of April 1, 2012. Measure “J” is a tax that can be used for any general purpose; however, the City has a history of using these funds to help with infrastructure improvements within the City.
STAFF ANALYSIS:
Transactions and Use (Sales Tax)
Revenues from Measure J are used to fund, or help fund, many general City services including significant improvements to downtown such as the downtown park and the Plaza Theatre renovation, street repair, many parks’ improvements including playground equipment and shade structures, and many projects initiated by residents of Palm Springs through the Community Initiated Project’s program.
Upcoming projects could include a remodel of the City’s Main Library and the construction of a new Fire Station #1. Measure “J” currently has a 25- year term and is scheduled to sunset on March 31, 2037, unless it is extended by Palm Springs voters. If approved by a majority of Palm Springs voters, this measure would extend the term of Measure “J” by removing the sunset. The measure would also make various technical updates to the sales tax ordinance required by the California Department of Tax and Fee Administration (CDTFA), the former Board of Equalization, that State agency that collects, processes and remits sales taxes to counties, cities and other local agencies. The technical changes are outlined in the attached ordinance.
It is staff’s recommendation that the City Council take action to adopt the resolutions to place the Measure “J” extension measure on the ballot for the November 5, 2024 General Election. Placing the measure on the ballot will give the City’s voters the opportunity to decide the level of service the City provides going forward.

Measure J ballot to extend term
Tax Measure Process
Under State law, extending the term of an existing tax is deemed a tax “increase”. The City Council does not have the authority to establish or increase local taxes, only to put a measure on the ballot for voter consideration. In order to place a tax measure on the November 5, 2024 ballot, the City Council must approve the submission of the measure to the voters by a 2/3 vote of the City Council (at least four affirmative votes). The resolutions also include the specific language for the ballot un question that will be presented to voters as required by Elections Code.
ALIGNMENT WITH STRATEGIC PLANNING:
This item aligns with City Council Strategic Priority 2, Community Infrastructure.
FISCAL IMPACT:
Measure “J” currently generates approximately $22 million in annual revenue that pays for City infrastructure improvements and other general services.
If approved by the City Council and adopted by a majority of the electorate, the tax would continue at its current 1% rate and would not sunset on March 31, 2037. Rather, the tax would continue beyond that date until repealed by Palm Springs voters at a s ubsequent election. There would be no immediate financial impacts from passage of the measure, as the existing tax will continue for several more years. However, after March 31, 2037, there would be a significant impact as Measure “J” revenues would remain in effect and not sunset.
The California Department of Tax and Fee Administration (CDTFA) will assess the City for preparatory charges to administer the new local sales tax based on actual costs. The statutory maximum amount of these costs shall not exceed $175,000; however, the “start- up” cost is usually much less than that, particularly given that CDTFA is simply being asked to continue collecting a tax currently in effect. CDTFA will also assess an annual administration fee that is typically a fraction of one percent of revenue collected. All other funding from the tax will be remitted to the City and remain under local control to fund City services and programs.
