CITY COUNCIL STAFF REPORT
DATE: November 12, 2025 CONSENT CALENDAR
SUBJECT: APPROVAL OF TRACT MAP WITH EMP2, LLC, A CALIFORNIA LIMITED

LIABILITY COMPANY
FROM: Scott C. Stiles, City Manager
BY: Engineering Services Department
SUMMARY:

Sikand Engineering Associates, representing EMP2, LLC, a California limited liability company, (the “Developer”), has requested approval of a final map for Tentative Tract Map 38998 to create six lots for a future development within Planning Area 1 (PA 1) of the Escena development located at 1000 North Gene Autry Trail. Approval of a final map for Tentative Tract Map 38998 is a ministerial action, as required by the Municipal Code and the Subdivision Map Act. All prior discretionary actions have occurred, allowing for the City’s ministerial approval of the final map.

RECOMMENDATION:

Adopt Resolution No. _____, “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING TRACT MAP 38998 WITH EMP2,

LLC, A CALIFORNIA LIMITED LIABILITY COMPANY, FOR PROPERTY LOCATED WITHIN PLANNING AREA 1 OF THE ESCENA DEVELOPMENT LOCATED AT 1000 NORTH GENE AUTRY TRAIL, IN SECTION 7, TOWNSHIP 4 SOUTH, RANGE 5 EAST.” BUSINESS PRINCIPAL DISCLOSURE:

The Public Integrity Disclosure Form from the Developer is included as Attachment A.

BACKGROUND:

At its meeting on January 22, 2025, the Planning Commission recommended conditional approval of Tentative Tract Map 38998 (TTM 38998) to subdivide an undeveloped 22.61 acres of land into six (6) parcels in PA 1 of the Escena development. PA 1, also referred to as the Resort Village, is located on the southeast corner of North Gene Autry Trail and East Vista Chino.

The expiration date of TTM 38998 was to be January 22, 2027; however, Sikand Engineering Associates, representing the Developer, timely filed a final map for TTM 38998 on March 4, 2025. Pursuant to state law (California Government Code Section 66452.6 [the “Subdivision Map Act”]), once the filing of a final map has been made to the City Engineer, all subsequent actions associated with the final map may occur after the expiration of the associated Tentative Tract Map.

STAFF ANALYSIS:

The Developer has completed all required reviews for the final tract map and the associated land is already considered annexed into the underlying Community Facility District (CFD). A site map is provided below, a vicinity map is included as Attachment B, and a copy of the final map for TM 38998 is included as Attachment C.

The City Engineer has determined that required conditions of approval associated with TTM 38998 have been satisfied, that Tract Map 38998 is in substantial conformance with the approved Tentative Tract Map, and that Tract Map 38998 is ready for City Council approval.

ENVIRONMENTAL ASSESSMENT:

The Planning Department has reviewed this project under the provisions of the California Environmental Quality Act (CEQA). In 1994 the City Council certified the Palm Springs Classic Planned Development District Final Environmental Impact Report (State Clearing House #9404274), adopted a Statement of Facts and Findings and a Statement of Overriding Considerations. Also, A Mitigated Negative Declaration (MND) was previously adopted by the City Council on July 16, 2003 for the Escena project and analyzed all significant environmental impacts and outlined mitigation measures of the project to bring them below a level of significance. Pursuant to Section 15162 of the California Environmental Quality Act (CEQA), the preparation of further documentation is not necessary because the circumstances of the project have not changed. The proposed tract map will not, therefore, result in any new environmental impacts beyond those already assessed in the adopted mitigated negative declaration.

ALIGNMENT WITH STRATEGIC PLANNING:

This item aligns with City Council’s Strategic Plan Broad Goal of Economic Development.

FISCAL IMPACT:

Approval of Tract Map 38998 for the currently vacant 22.61-acre parcels will allow for a future development within PA 1. Ultimately, upon completion of the future development, the City will receive yet to be determined additional property tax revenue. Additional, incremental costs for public service will be incurred over time.
