STAFF ANALYSIS:

On September 12, 2022, the City of Palm Springs entered into Agreement No. A9206 with Same Day Express, dba Signature Sculpture ("Contractor"), for the cleaning and maintenance of public art within the City. The original three-year agreement had a contract price of $128,905.

The agreement has been amended twice previously:

Amendment No. 1 (March 13, 2023): This amendment added services for the repair of the "Chairman of the Links" art piece, in the amount of $895.00 bringing the total contract price to an amount not to exceed $128,905.

Amendment No. 2 (February 3, 2025): This amendment expanded the scope of work to include seven art pieces at the Palm Springs International Airport, increased compensation by $9,999.50, bringing the total contract amount to $139,799.50 and extended the contract term to August 31, 2027.

The proposed Amendment No. 3 will further revise the scope of services to include the regular cleaning and maintenance of eighteen (18) additional art pieces located throughout the City, for a total of 40 art pieces to be cleaned twice a year. These new pieces to be added include the Pillars on East Tahquitz Canyon Way, Creature Alley, Artscape in the Park, and Beautiful Shade.

Services for the new pieces, as detailed in the attached Exhibit A2, will primarily consist of washing with non-ionic soap and deionized water and applying wax, performed twice annually. This amendment increases the contractor's compensation by $134,905. The total compensation for the agreement, as amended, will not exceed $274,704.50.

This amendment ensures that the City's growing collection of public art is properly and professionally maintained, preserving the condition and longevity of these valuable community assets.

In accordance with Section 15304 "Minor Alterations to Land," Class 4 projects consist of "minor public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of healthy, mature, scenic trees except for forestry and agricultural purposes" and approval of this item is considered categorically exempt from CEQA.
