Tahquitz Canyon Way Palm Springs, CA 92262 Regarding: Needed Capital Project on the E Tahquitz Canyon Way Sewer Main Dear Mr. Crider, The sewer main on E Tahquitz Canyon Way from Sunset Way to Farrell Drive is flowing up to 90% full in
places.
Therefore,
we
would
like
to
request
a
Needed
Capital
Improvement
Project
for
the
upsize
of
the
sewer
main.
Section 5.3 Capital Projects from Wastewater Services Agreement dated November 4, 2015 states, in part: 5.3 (a) Defined. Capital Projects shall include a permanent physical expansion, addition or improvement to the Managed
Assets,
including
the
replacement
of
existing
equipment
or
facilities
with
new
or
additional
equipment
or
facilities
as
a
result
of
old
age,
obsolescence
or
breakdown
of
such
equipment
or
facility,
which
are
(i)
mutually
agreed
upon
by
the
City
and
Veolia
("Agreed
Capital
Projects");
(ii)
which
are
either
directly
as
a
result
of
a
Change
of
Law
or
in
order
for
the
Treatment
Facility
to
produce
Effluent
meeting
the
Effluent
Specifications
and
result
from
(A)
a
Change
of
Law,
(B)
an
Uncontrollable
Circumstance,
(C)
actual
or
anticipated
changes
in
Influent
volumes
and
demands
on
the
Managed
Assets,
or
(D)
repeated
occurrences
of
Influent
in
volumes
or
concentrations
that
exceeds
the
Influent
Specifications
or
that
contains
Abnormal
Substances
or
Regulated
Substances
("Needed
Capital
Projects");
or
(iii)
improve
the
efficiency,
performance
or
reliability
of
the
Managed
Assets
("Desirable
Capital
Projects").
A
Capital
Project
shall
not
include
any
Maintenance
Work,
as
defined
in
Section
5.4,
or
any
capital
project
initiated
and
implemented
by
the
City
associated
with
the
generation
of
electricity
by
solar
photovoltaic
or
equivalent
technology
at
the
Treatment
Facility
Site,
(a
"Solar
PV
Project");
the
City,
in
its
sole
discretion,
may
determine
to
construct
the
Solar
PV
Project
which
will
require
direct
interconnection
with
the
existing
electrical
system
at
the
Treatment
Facility,
and
Veolia
shall
reasonably
accommodate,
to
the
extent
necessary,
with
the
City,
or
its
consultant
or
contractor,
in
the
design
and
construction
of
a
Solar
PV
Project.
The
area
of
the
Treatment
Facility
Site
reserved
by
City
for
its
use
for
the
Solar
PV
Project
is
identified
on
the
map
depicting
the
Treatment
Facility
Site
identified
on
Schedule
B.
(e) Notice. Veolia shall provide to City notice of any Needed Capital Project or Desirable Capital Project.
Veolia's
notice
shall
state
the
category
of
Capital
Project,
as
set
forth
at
Section
5.3(a)
above
and
whether
the
basis
for
the
Capital
Project
is
as
a
result
of
a
Change
of
Law,
an
Uncontrollable
Circumstance,
an
actual
or
anticipated
change
in
Influent
volumes
and
demands
on
the
Managed
Assets
(and
identify
the
specific
asset
affected),
repeated
occurrences
of
Influent
in
volumes
or
concentrations
that
exceeds
the
Influent
Specifications
or
to
improve
the
efficiency,
performance
or
reliability
of
the
Managed
Assets.
Veolia
shall
further
provide
City
with
a
budget
itemizing
the
anticipated
costs
of
performing
the
Capital
Project.
