Section 7.5 Direct Cost Items.
If Veolia is to be reimbursed under this Agreement for an item on a direct cost basis, such as Biosolids Services pursuant to Section 5.2(d), Street Sweeping services pursuant to Section 5.2(t), Rolling Stock Maintenance Services pursuant to Section
5.6(c) and Section 5.6(d), or any other third-party or sub-contracted services, an administrative overhead fee of fifteen percent (15%) shall apply and be paid by City in addition to such services. City shall have the right to request that Veolia seek competitive bids for such items or work; provided, however, that (i) Veolia shall not be obligated to follow the City's bidding process or any other process applicable to public agencies under Applicable Law; (ii) this paragraph shall only apply to work or items that are subcontracted by Veolia and shall not apply to Compensation payable to Veolia under this Agreement for work performed by Veolia's own personnel; (iii) Veolia shall make reasonable efforts to obtain at least three (3) competitive bids; (iv) competitive bidding on an individual scope of work shall not be required more frequently than the later of (1) once every three (3) years; or (2) in the case of an individual scope of work with respect to which a subcontract has been entered into, until the term of that subcontract has expired. If, after good faith efforts, Veolia receives two (2) competitive bids for a subcontracted scope of work, Veolia may proceed to enter into negotiations with the subcontractor submitting the lowest bid. If, after good faith efforts, Veolia
receives one (1) competitive bid for a subcontracted scope of work, Veolia may proceed to enter into negotiations with that subcontractor provided the overall cost for that individual scope of work will not increase more than ten percent (10%) above the previously subcontracted scope of work, in which case Veolia shall repeat its efforts to solicit competitive bids. If, after good faith efforts, Veolia receives no competitive bids, Veolia may renegotiate the subcontract for which competitive bidding was initiated, provided the overall cost for that individual scope of work will not increase more than ten percent (10%) above the previously subcontracted scope of work, in which case Veolia shall repeat its efforts to solicit competitive bids.
If you require any further information, please contact me at the facility.

Subject: Scope of Work for Nitrogen Effluent Limit Compliance Technical Report, WDR Special Provision
Dear Mr. Segoviano,
Larry Walker Associates (LWA) would be pleased to assist the City of Palm Springs (City) with preparing the Total Nitrogen Effluent Limit Compliance Technical Report (Technical Report) due to the California Regional Water Quality Control Board, Colorado River Basin Region (Regional Water Board) on June 1, 2026. The Waste Discharge Requirements (WDR) for the Palm Springs Wastewater Treatment Plant (WWTP), Order No. R7-2024-0009 (Order), includes Provision G.2.a which required the City to submit a Total Nitrogen Effluent Limit Compliance Time Schedule. The schedule was submitted to the Water Board on July 9, 20241, and includes submittal of the Technical Report, as described below:
Submit technical report identifying and assessing treatment options for compliance with the effluent limit within 10 years including evaluation of treatment alternatives and evaluating feasibility of using effluent for recycled water application, including discharging to Desert Water Agency for treatment and delivery of recycled water.
LWA is submitting this scope of services to assist the City with the Technical Report described above.
The scope of work, budget and schedule for this effort are provided below.
SCOPE OF WORK
Task 1. Data Compilation and Review
LWA will compile and review influent and effluent data for total nitrogen, nitrate, and nitrite, along with a description of treatment plant operations.
Task 2. Evaluate Treatment and Other Compliance Alternatives LWA will evaluate treatment alternatives for nitrogen removal such as process optimizations, nitrification and denitrification with activated sludge, implementation of denitrification filters, Membrane Aerated Biofilm Reactors (MABRs), or other approaches that may be identified. LWA will also evaluate the feasibility of discharging to Desert Water Agency (DWA) and recycled water uses where current nitrogen levels are not problematic. Finally, LWA will assess compliance alternatives such as implementing a mass-based limit instead of a concentration-based limit. The evaluation will consider technical feasibility, the level of coordination required with other entities ( such as DWA), regulatory implications, and financial considerations.
