Spectrum Easement at 305 North Civic Drive
BACKGROUND:

Since 2011, the City and Enterprise have maintained a non-exclusive operating and lease agreement for the operation of a car rental concession. Under this agreement, Enterprise leases multiple areas within airport property to support its rental car operations. One such leased area is located at 305 North Civic Drive, designated as a maintenance yard lot.

This maintenance yard lot serves as a central hub for Enterprise’s rental car operations, providing space for vehicle repairs, storage, staging, and staff operations, which is necessary to support the overall functionality of the car rental service.

The easements are required to establish a dedicated underground pathway for communication facilities, specifically data lines connecting to the existing office in the maintenance yard. A hard-wired data connection is critical to ensure reliable, secure, and high-performance network connectivity, as wireless solutions alone cannot provide the level of operational continuity required for high-volume, mission-critical airport rental car operations.

STAFF ANALYSIS:

The Grants of Easement will establish a dedicated utility corridor measuring approximately 14 feet by 59 feet to allow Spectrum to install, operate, maintain, upgrade, repair, and remove its cable and communications infrastructure. This infrastructure includes underground and surface elements such as data lines, conduits, utility cabinets, electronic equipment, and related support structures.

The Easement Agreements Attachments A & B granting the easement including legal description and map exhibit Attachment C, have been reviewed for consistency with the existing lease agreement and approved as to form by the City Attorney.

ENVIRONMENTAL ASSESSMENT:

The requested City Council action is not a “Project” as defined by the California Environmental Quality Act (CEQA). Pursuant to Section 15378(a), a “Project” means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. According to Section 15378(b), a Project does not include: (5) Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.

ALIGNMENT WITH STRATEGIC PLANNING:

Approval of this action supports the City of Palm Springs’ Strategic Plan Broad Goals of Economic Development and Infrastructure and Facilities, and also supports the Airport’s 2025-2029 Strategic Plan’s Strategic Priorities for infrastructure.

FISCAL IMPACT:
