The City’s twelve (12) existing pickleball courts are located at Demuth Park at 4375 E.

Mesquite Avenue, Palm Springs. The courts are highly utilized year-round and provide a free health and wellness recreational amenity for the community. The Parks & Recreation Commission and members of the pickleball community mutually agreed that there was a need to increase the number of courts available in Palm Springs to better meet the high demand of players in the growing pickleball community, as well as create a cohesive design and better-functioning recreational amenity. On July 24, 2023, City Council awarded Professional Services Agreement No. 23P173 to Kimley-Horn in the amount of $161,395 for design services needed for the Demuth Park Pickleball Expansion, City Project No. 22-24. Upon award of the contract and Project commencement, Kimley-Horn began working with Staff, the Parks & Recreation Commission, the Pickleball Ad-Hoc Group of the Parks & Recreation Commission, the community, and stakeholders to help conceive a conceptual plan for increasing the number of pickleball courts at Demuth Park, with the goal of creating a concept that reflected the needs of the sport. Subsequently, Purchase Order No. 24000299 was created in the amount of $161,395 comprised of funding equally split between Measure J Funds and Quimby Funds.

On June 27, 2024, City Council approved Kimley-Horn Amendment No.1 to Professional Services Agreement No.23P173 in the amount of $100,000, which was needed to cover additional project meetings, community engagement, and site research to develop a conceptual design for the Project for presenting to the Parks & Recreation Commission.

On February 13, 2025, the City Council approved the plans, specifications, and engineer’s estimate for the Project and authorized Staff to advertise and solicit bids. Also approved

was Amendment No. 2 in the amount of $146,800, for a new not-to-exceed amount of $408,195. This amendment covered the additional civil engineering services, construction administration services, project meetings, and utility coordination.

On February 18, 2025, the Project initially went out to bid with a closing date of April 14th.

Upon opening bids, the lowest responsive bid was substantially higher than the Project budget. As a result, City Council subsequently approved Staff’s recommendation of rejecting all bids, reassessing the Project, and rebidding at a later date.

On June 17, 2025, the Project went out to bid for a second time with a closing date of July 9th. With the Project being split into one primary Bid Schedule (A) and four additive bid schedules (B, C, D, & E), only Bid Schedule A fell within budget and was subsequently awarded on July 21st.

STAFF ANALYSIS:

On September 15, 2025, a Notice to Proceed was issued to start construction of the Project. Since then, there have been several unforeseen conflicts discovered within the subsurface such as deteriorating water service lines and unforeseen utilities. This resulted in relocating existing/proposed utility lines, and adjustments to some light pole and shade structure foundations. These unforeseen conditions have also prolonged the construction by an estimated 30 calendar days.

On March 13, 2026, Kimley-Horn submitted a proposal in the amount of $60,000 for the additional support during bidding, Project meetings, and construction support needed due to the prolonged Project schedule. Staff is recommending approval of Amendment No. 3, which is included as Attachment B.

ENVIRONMENTAL ASSESSMENT:

Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA. In accordance with Section 15301 "Existing Facilities," Class 1 projects consist of the operation, repair, maintenance, minor alteration of existing public structures, facilities, or topographical features involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. Therefore, in accordance with Section 15301 (c), Staff has determined that the Demuth Park Pickleball Court Expansion Project, City Project No. 22-24, is considered categorically exempt from CEQA and a Notice of Exemption was filed with the Riverside County Clerk.

ALIGNMENT WITH STRATEGIC PLANNING:

This item aligns with the following City Council Strategic Plan Broad Goal:
