RESOLUTION NO.
“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, APPROVING THE
REQUEST FOR PROPOSALS/QUALIFICATIONS FOR THE
ROTATIONAL TOW PROGRAM, AUTHORIZING STAFF TO
ADVERTISE AND SOLICIT RESPONSES FOR THE PALM
SPRINGS POLICE DEPARTMENT.”

HEREAS, the City of Palm Springs Police Department impounds and tows numerous and various vehicles removed from highways, public property, or private property in the city of Palm Springs during the normal course of duty; and

HEREAS, the City of Palm Springs Police Department tows and/or impounds vehicles pursuant to authority under the California Vehicle Code; and W
HEREAS, the City of Palm Springs Municipal Code 11.82.100 establishes a Vehicle Towing Administrative Cost Recovery (VT ACR) fee charged to each tow company entering into an agreement with the City of Palm Springs; and W
HEREAS, the VTACR Fee identified in the Request for Proposals/Qualifications is based on the actual and reasonable costs to the City, including administration and overhead, for administering the official police tow services providers' agreement and operating the vehicle towing program; and

HEREAS, City of Palm Springs City Council adopted the VTACR Fee on March 14, 2024, setting the maximum allowable towing fees to be charged by each tow company entering into an agreement with the City of Palm Springs.

W, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL HEREBY FINDS AND DETERMINES THAT:

ECTION 1. Findings.

hat City staff has prepared a Request for Proposals/Qualifications for the rotational tow program in accordance with Palm Springs Municipal Code 11.82. b. P
alm Springs Municipal Code Section 11.82.060 “Selection process: regulates the methods by which the City can select contractors to provide tow services for the Police Department and are specifically outline in the Request for Proposals/Qualifications.

ECTION 2. That the findings and determinations reflected above are true and correct, and are incorporated by this reference herein as the cause and foundation for the action taken by and through this Resolution.

ECTION 3. In accordance with Section 11.82.060 of the Palm Springs Municipal Code , the City Council hereby authorizes the solicitation and advertisement of the Request for Proposals/Qualifications (RFQ 04-26) for the rotational tow program for the Police Department.
