as the Federal Water Pollution Control Act, it was significantly reorganized and expanded in 1972, becoming the CWA.
The CWA prohibits discharging pollutants from a point source into navigable waters without a permit. EPA's National Pollutant Discharge Elimination System (NPDES) controls these discharges from discrete conveyances such as pipes or man-made ditches. Homes connected to municipal systems or using septic systems are exempt, but industrial, municipal, and other facilities discharging directly to surface waters must obtain permits. The CWA also regulates urban runoff from Municipal Separate Storm Sewer Systems (MS4s) under NPDES.
On June 20, 2013, the Colorado River Basin Regional Water Quality Control Board issued Permit Order No. R7-2013-0011 to the City, governing the MS4 network of streets and storm drains conveying runoff to waters including Tahquitz Creek, Palm Canyon Wash, and the Whitewater River. The permit aims to prevent polluted runoff from development projects, industrial facilities, restaurants, and commercial sites from reaching U.S. waters.
The permit requires the City to inspect construction sites, industrial facilities, restaurants, and commercial sites. Inspection frequency is determined by factors such as business type, potential pollutants, compliance history, and proximity to impacted waters. Using Standard Industrial Codes (SIC), businesses are classified as high, medium, or low priority requiring inspections annually, every two years, or every five years, respectively.
On April 7, 2015, the State Water Resources Control Board adopted a Trash Amendment to the permit, requiring all NPDES permittees to eliminate trash discharges into state surface waters. Full compliance, including installation and operation of certified Full Capture Systems or equivalent controls within all priority land-use areas must be achieved by December 2, 2030. As this deadline approaches, the City must maintain consistent implementation and maintenance efforts to meet annual reduction milestones and avoid potential regulatory enforcement.
On June 24, 2021, the City Council approved Agreement No. A8883 with CASC engineering for a 3-year term with two one-year extension options. The last extension of the current Agreement will expire at the end of June 2026.
STAFF ANALYSIS:
To maintain ongoing compliance with NPDES Permit, the City issued RFQ 2026 on March 6, 2026, requesting proposals from qualified firms to provide on-call program support.
Four proposals were received from four qualified consultants by the April 23, 2026, deadline, listed below.

The Selection Committee selected CASC Engineering and Consulting, Inc. as the top firm. CASC showed a comprehensive understanding of the NPDES program and is able to assist the City by updating policies, perform inspections, ensure BMP and SWPPP compliance, and support staff development. They can also provide quick technical help to multiple City departments to keep related programs coordinated. CASC has a strong history of helping and training local agencies on NPDES requirements in the Whitewater region. CASC’s Response to the RFQ is included in Attachment B.
ENVIRONMENTAL ASSESSMENT:
In accordance with the California Environmental Quality Act (“CEQA”) Guidelines the requested City Council action is not a “Project” pursuant to Section 15378(b)(5).
Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment are not considered a “Project”.
ALIGNMENT WITH STRATEGIC PLANNING:
This item aligns with the following City Council Strategic Plan Broad Goal: Public Safety and Community Services.
FISCAL IMPACT:
Funding associated with monitoring for and compliance of the NPDES Program is made available through a special enterprise fund called the Community Service Area 152 (“CSA 152”) Fund, appropriated in Fund 124. Riverside County first established CSA 152 to levy a special tax to generate revenue associated with implementing various programs associated with the NPDES Program; the City annexed into CSA 152 in 1993, to allow for the levy of assessments to offset the City’s costs related to administering its NPDES Program. Expenditures for individual “Task Orders” approved will be encumbered from the CSA 152 fund.
