SUMMARY:
Award of this professional services agreement will allow the City to proceed with construction preparation of the East Palm Canyon Drive Bridge, City Project No. 12-04, Federal Aid Project No. BRLS 5282(041), (the “Project”).
RECOMMENDATION:

Lin overhead rate. 2) Authorize the City Manager to execute all necessary documents.
BUSINESS PRINCIPAL DISCLOSURE:
A copy of the T.Y. Lin International (TYLin) Public Integrity Disclosure Form is included as Attachment A.
BACKGROUND:
The East Palm Canyon Drive Bridge, constructed in 1956 and widened in 1963, is listed in the Federal Eligible Bridge List with a status of “Structurally Deficient (SD)” and a low Sufficiency Rating (SR) of 53.6 according to the Bridge Inspection Report (BIR) prepared by Caltrans Office of Structure Maintenance and Investigations. Since the bridge is rated with an SR lower than 80, the bridge is eligible for major rehabilitation in accordance with

The Project includes a seismic retrofit and widening of the existing bridge over the Palm Canyon Wash. East Palm Canyon Drive will be maintained with four lanes of traffic (two east bound, two westbound), separated by a new ten-foot-wide striped center median.
The roadway shoulders will be widened to accommodate Class II bicycle lanes and a new ADA-compliant sidewalk on the south side of the bridge. A retaining wall will be installed along the south side of East Palm Canyon Drive adjacent to the Horizon Mobile Village & RV Park. A traffic signal will be installed at the intersection of East Palm Canyon Drive and Rim Road/Southridge Drive. The bicycle/pedestrian bridge on the north side will remain, however, the deteriorated wood deck and railings will be replaced.
Subsequently, the City entered into a Professional Services Agreement with CNS Engineering Inc. (CNS), to prepare the Project Study Report, which would detail the overall Project scope and funding package to submit to the Federal Highway Bridge Program (HBP), which is administered by the State of California Department of Transportation (“Caltrans”).
The federal funding request was ultimately approved by Caltrans, with the HBP funds covering 88.53% of eligible Project costs, requiring an 11.47% local match. Pursuant to a previous funding agreement with CVAG, the local funding amounts were funded by CVAG with 75% Regional Measure A funds with the remaining 25% funded by Palm Springs. Any costs that are not eligible per HBP funding requirements will be split between

Approve CM Agreement for CP 12-04 East Palm Canyon Bridge CVAG and the City. The budget with Caltrans has been revised over time as additional scope and costs have been identified. The most current funding request is detailed in the Staff Analysis below.
STAFF ANALYSIS:
Given the scale of the Project, it is essential that the City engages early with a construction management firm to ensure all preconstruction surveys are completed, environmental measures are in compliance per current mandate updates, to develop and administer a community outreach program to include public outreach meetings before and during construction, and recommend the most efficient project staging to reduce impacts to traffic and the surrounding communities/businesses.
Request for Proposals for Construction Management Services On March 30, 2026, the City issued Request for Proposals (RFP) 12-04 CM to invite consultants to provide proposals for “turnkey” construction management, inspection, material testing, and preconstruction services needed for the Project. As a federally funded Project, this scope of work required a separate solicitation in accordance with federal guidelines.
On April 23, 2026, the City received a total of six (6) individual proposals from C2PM, CHA Consulting, Inc., CQMS Inc., DCCM Infrastructure, Inc., Harris & Associates, Inc., and T.Y. Lin International.
An evaluation committee reviewed the proposals following the federal process for consultant selection entirely based on qualifications and experience per criteria specified in the RFP, including interviewing the top two firms. Fee is not and cannot be a factor for professional services. Based on this review, Staff recommended TY Lin as the most qualified consultant for these services. Staff negotiated the final scope and fee with TY Lin and believe they have presented a fair and reasonable price for the requested scope.
A copy of the Agreement with TY Lin is included as Attachment B.
As part of the consultant selection procedures outlined in the Caltrans Local Assistance Manual, any contract with a total value over $1M is subject to an additional review by the Independent Office of Audits and Investigations to confirm that the proposed indirect cost rate was developed in accordance with the appropriate federal requirements. This review has been submitted, and the final contract value may deviate based on the results. Staff recommends this award be made contingent upon Caltrans approval, at which time the final agreement will be dated and signed.
ENVIRONMENTAL ASSESSMENT:
Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act (“CEQA”). In accordance with City Council Staff Report
July 8, 2026 -- Page 4
Approve CM Agreement for CP 12-04 East Palm Canyon Bridge the CEQA Guidelines, the City acting as “Lead Agency” pursuant to CEQA, previously completed an environmental analysis of the potential impacts resulting from construction of the Project. The Project is funded, in part, by federal funds, requiring local oversight by the State of California, Department of Transportation (“Caltrans”).
As a federally funded project, the Project is subject to environmental review pursuant to the National Environmental Policy Act (“NEPA”). On November 3, 2017, Caltrans, acting as the lead agency pursuant to NEPA, made an environmental determination that the Project does not individually or cumulatively have a significant impact on the environment as defined by NEPA and is excluded from the requirements to prepare an Environmental Assessment (“EA”) or Environmental Impact Statement (“EIS”), has considered unusual circumstances pursuant to 23 CFR 771.117(b), and that it qualifies for a Categorical Exclusion in accordance with 23 CFR 771.117(d).
ALIGNMENT WITH STRATEGIC PLANNING:
This item aligns with the following City Council Strategic Plan Broad Goal: Infrastructure and Facilities.
FISCAL IMPACT:
