STAFF ANALYSIS:
The City Council voted to introduce Ordinance No. 2133, subject to certain revisions which were made at the time of first reading. The revisions were related to:
SECTION 6: Section 5.25.070, subdivision (k) removing the language “Any failure to cure the violation subject to this section within sixty (60) minutes will result in an issuance of an administrative citation for the violation in question”. Accepting Staff position of support related to VRONS recommendation “Eliminate requirement to post the Registration Certificate and applicable operational conditions on-site” by amending Section 5.25.070(n) to “The owner of the vacation rental unit shall post a copy of the registration certificate and a copy of the conditions set forth in this section, including all rules and regulations applicable to the use of the property as a vacation rental, on the inside of the front door and the primary door to the backyard or in a conspicuous location near each such door” accessible to guest”.
Section 9: 3.24.085(d)(2)
oIt shall be unlawful for any short-term rental facilitator to complete any booking transaction for any vacation rental or homeshare unless that vacation rental or homeshare is listed on the City’s registry created and maintained by the City’s Department of Special Programs, at the time the hosting platform receives a fee for the booking transaction.
ENVIRONMENTAL ASSESSMENT:
This Ordinance is not subject to the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) pursuant to Section 15060(c)(2) and 15060(c)(3) of the State Guidelines, because the Ordinance will not result in a direct or reasonably foreseeable indirect physical change in the environment and is not a "project," as that term is defined in Section 15378 of the State Guidelines. In addition, the City Council also determines this Ordinance consists of regulations intended to ensure that the incidental short term rental use of residential property remains an ancillary and secondary use of residential property in the City and thereby preserve the residential character of the City's City Council Staff Report

single- family and multi-family neighborhoods as identified in the City's adopted General Plan, and its concomitant Environmental Impact Report. Thus, to the extent there is any environmental impact from the adoption of this Ordinance, the City Council finds that the Environmental Impact Report for the adopted General Plan is the controlling environmental document.
FISCAL IMPACT:
There is no fiscal impact with the proposed modifications. Any incremental administrative workload will be absorbed within existing staff capacity. No new appropriations are required.
