SUBJECT: APPROVE CONTRACT AGREEMENTS NO. 26B181 AND 26B182 WITH POLAR ELECTRICAL COMPANY AND NO. 26B183 AND 26B184 WITH M. BREY, INC., DBA MBE CONSTRUCTION, FOR ELECTRICAL REPAIR
AND INSTALLATION SERVICES

SUMMARY:
This action will approve Construction Agreement No. 26B181 in an amount not to exceed $900,000, and Contract Services Agreement No. 26B182 in an amount not to exceed $75,000 with Polar Electrical Company; and Construction Agreement No. 26B183 in an amount not to exceed $575,000, and Contract Services Agreement No. 26B184 in an amount not to exceed $75,000 with M. Brey, Inc., dba MBE Construction, for electrical repairs and installation services for the Public Works department.
RECOMMENDATION:
1) Approve Construction Agreement 26B181 (Attachment A) with Polar Electrical Company to provide electrical installation services for the Public Works department in an amount not to exceed $900,000 for an initial one-year term beginning September 10, 2026, through September 9, 2027, with four one-year extension options at the City’s sole discretion; and
2)Approve Contract Services Agreement 26B182 (Attachment B) with Polar Electrical Company to provide electrical repair services for the Public Works department in an amount not to exceed $75,000 for an initial three-year term beginning September 10, 2026, through September 09, 2029, with two one-year extension options at the City’s sole discretion; and
3) Approve Construction Agreement 26B183 (Attachment C) with M. Brey, Inc., dba MBE Construction to provide electrical installation services for the Public Works department in an amount not to exceed $575,000 for an initial one-year term beginning September 10, 2026, through September 9, 2027, with four one-year extension options at the City’s sole discretion; and

4) Approve Contract Services Agreement 26B184 (Attachment D) with M. Brey, Inc., dba MBE Construction to provide electrical repair services for the Public Works department in an amount not to exceed $75,000 for an initial three-year term beginning September 10, 2026, through September 09, 2029, with two one-year extension options at the City’s sole discretion; and
5) Authorize the City Manager or designee to execute all necessary documents.
BUSINESS PRINCIPAL DISCLOSURE:
According to the Public Integrity Disclosure Forms (Attachments E and F) submitted on August 5, 2026 and August 6, 2026, respectively, Polar Electrical Company and M. Brey, Inc., dba MBE Construction, are both registered in the state of California.
BACKGROUND:
The City of Palm Springs requires qualified contractors to provide electrical repair and installation services at various City buildings and facilities managed by the Public Works Department. Due to the volume and extent of electrical services required to maintain and repair existing infrastructure, staff determined that the available funding under the current contracts will be fully expended prior to their scheduled expiration. As a result, staff elected to resolicit bids to ensure continuity of services and avoid delays in completing necessary electrical work.
Building on the success of the electrical service contracts awarded in 2022 and 2024, staff are recommending approval of four new contract agreements. The proposed agreements will provide a primary and secondary contractor for electrical installation services and a primary and secondary contractor for electrical repair and maintenance services. These contracts will support ongoing facility maintenance needs as well as planned building renovation and improvement projects throughout the City.
STAFF ANALYSIS:
The contracts with Polar Electrical Company and M. Brey, Inc., dba MBE Construction are on-call, as-needed type contracts. The bids were used to determine the lowest, responsive, responsible bidders and to set the unit rates for the contracts; however, the actual amount of the contracts is based on the budgeted amount set by the Department and will therefore not match the bid amounts.
An Invitation for Bids (IFB 26-16) was initiated by the City’s Procurement and Contracting Department on July 13, 2026, based on the Department of Public Works specifications.
Bids were solicited directly via the City’s procurement vendor portal, PlanetBids. In addition, the IFB was advertised in The Desert Sun. Seven bids were received by the August 6, 2026, deadline as follows:

Fox Company Electric, LLC – Desert Hot Springs, CA $2,353,990.84 DDP Electric, Inc., was deemed non-responsive for not completing the required forms, and Reliable Electric was deemed non-responsive for lack of acknowledgement of the addenda issued during the solicitation process.
The Department’s intent for this solicitation was to award four contracts to the two lowest responsive and responsible bidders. Unit pricing will remain fixed for the first year and will be subject to CPI adjustments in subsequent years.
Staff recommend approval of the following agreements, effective September 10, 2026:

ENVIRONMENTAL ASSESSMENT:
The requested City Council action is not a “Project” as defined by the California Environmental Quality Act (CEQA). Pursuant to Section 15378(a), a “Project” means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. According to Section 15378(b), a Project does not include: (5) Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.

FISCAL IMPACT:
The total not to exceed amount of all four contracts is $1,625,000. Funding is available in the 2026-27 budget and will be budgeted in subsequent years.
