RECOMMENDATION:
1) Approve Participating Addendum (Attachment A) 26C189, with Amazon.com Services LLC for the purchase of materials and supplies for an annual amount not to exceed $300,000 for an initial term ending on January 18, 2028, with two additional two-year periods;

Amazon.com Services LLC is a subsidiary of the publicly traded parent company Amazon.com, Inc.

BACKGROUND:

City Departments have a need to purchase various materials and supplies to ensure successful delivery of their job functions. Historically, the City had utilized a claim voucher process to purchase office supplies and materials and has been pursuing retainage of contractual agreements to make the process more transparent and efficient.

The City currently utilizes Agreement A9324 with ODP Business Solutions for the purchase of office supplies, pursuant to the Omnia Cooperative Contract R190303 for an annual amount of $200,000. Departments often obtain quotes when purchasing supplies

Approve Addendum 26C189 with Amazon for Materials and Supplies or price check through various vendors to ensure they are obtaining the best possible price for their supplies. Oftentimes staff find that the same or similar products are available through Amazon at lower cost.

STAFF ANALYSIS:

Staff intend to utilize the existing Agreement A9324 with ODP Business Solutions with an annual expense not to exceed $200,000 and the proposed Agreement 26C189 with Amazon for an annual expense not to exceed $300,000 for current and future purchases of materials and supplies. Typical purchases conducted through these types of materials and supplies contracts are general office supplies.

In accordance with City of Palm Springs Municipal Code Section 7.03.09, “Special Procurement Methods,” Section 5, “Cooperative Purchasing Programs”, the City Council may authorize the acquisition of supplies or services through a joint powers or other cooperative purchasing program with a public entity or association of public agencies or officials, provided that the vendor selected has been selected through a competitive process and the department finds that the competitive process is similar to that contained in Title 7 or adequate to protect the public interest, and that due to economies of scale, the nature of the product, or market conditions, the price of the supplies or services is likely to be less through the cooperative purchase than through the City’s independent purchasing pursuant to Title 7.

Omnia Partners is a public agency that conducts competitive solicitations and awards contracts to qualified vendors, allowing participating agencies to benefit from volume pricing and streamlined procurement processes. This cooperative purchasing arrangement provides competitive pricing and efficient procurement to support the operational needs of the City Departments through Omnia Partners Contract #R-TC- 17006 for the purchase of materials and supplies.
