BUSINESS PRINCIPAL DISCLOSURE:
According to the Public Integrity Disclosure form (Attachment B), Axon Enterprise, Inc., is registered in the state of Delaware.
BACKGROUND:
The Palm Springs Police Department has utilized TASER conducted energy devices as a critical component of its less-lethal force options since 2005. CEDs are self-defense tools relied upon by officers to overcome the resistance presented by violent, combative subjects while minimizing the injury potential for both officers and the involved subject.
These devices have proven to be highly effective in stopping even the most focused and aggressive subjects.
In October 2016, City Council approved the purchase of 93 TASER Model X26P devices and associated hardware from Proforce Law Enforcement in the amount of $106,347.82 to replace the Department's aging inventory of Model X26 devices, which had been in service for 8–10 years. As with the prior replacement cycle, the Department's current inventory of X26P devices has now reached the end of its serviceable life, and the manufacturer has advanced its product line to the TASER 10 platform.
Market research has provided that the TASER Model X26P devices have an estimated resale value of approximately $500 per unit through secondary-market platforms. If the department pursued the surplus option instead of the buy-back credit option, the potential resale value of these devices could generate an estimated return of up to $46,500, in comparison to the $55,534.24 offered through the buy-back credit.
This estimated market value supports the determination that accepting the buy-back credit offered by Axon represents a cost-effective option for the City. The buy-back program allows the Department to apply value from its existing equipment toward the acquisition of upgraded devices, thereby reducing the overall cost of replacement and maximizing the value of previously purchased equipment.
The Palm Springs Police Department Policy Manual, Section 304, governs the use of conducted energy devices and establishes comprehensive guidelines for CED deployment, training, documentation, and supervisory review. The policy recognizes that CEDs provide officers with a less-lethal option that may be used when a person is violent or physically resisting or has demonstrated an intention to be violent, and the TASER 10 is specifically referenced in the policy as an approved CED platform.
STAFF ANALYSIS:
In order to be consistently effective, conducted energy devices require routine maintenance, battery recharging/replacement, software updates, and data downloads. As equipment ages, the manufacturer discontinues service, maintenance, software updates, and replacement parts, rendering the devices unserviceable. Axon Enterprise, Inc.

Purchase of Axon TASER 10 Conducted Energy Devices
(formerly TASER International) is the only company that manufactures a consistently reliable, time-tested conducted energy device, and as a result, the TASER product line is most often utilized by contemporary law enforcement organizations.
The Axon TASER 10 represents the latest advancement in CED technology. The Department's current policy notes that on the TASER 10, each trigger pull deploys a single probe, requiring the officer to pull the trigger twice to deploy two probes to create the possibility of neuro-muscular incapacitation. The certification bundle included in this purchase provides comprehensive hardware, software, services, and warranties over the five-year term, ensuring that Department personnel have access to these valuable tools without interruption throughout the term of the agreement.
In accordance with City of Palm Springs Municipal Code Section 7.03.09(5), "Cooperative Purchasing Programs," the City Council may authorize the acquisition of supplies or services through a joint powers or other cooperative purchasing program with a public entity or association of public agencies or officials, provided that the contractor selected has been selected through a competitive process and the Director finds that the competitive process is similar to that contained in Title 7 or adequate to protect the public interest, and that due to economies of scale, the nature of the product, or market conditions, the price of the supplies or services is likely to be less through the cooperative purchase than through the City's independent purchasing pursuant to Title 7.
The City participates in purchases through cooperative purchasing organizations such as OMNIA, HGAC, and Sourcewell. These contracts fulfill the need to obtain quotes or perform a formal solicitation process as they have already been procured by a qualifying agency. The contract must be open for use, the items needed must be on the contract, and the price offered to the City must be at or below the price listed on the cooperative contract. Staff have determined that the cooperative contract utilized for this purchase meets the requirements of Municipal Code Section 7.03.09(5). The cooperative purchasing arrangement provides competitive pricing and efficient procurement to support the operational needs of the Police Department.

FISCAL IMPACT:
The total cost of the proposed Axon Enterprise, Inc. Cooperative Purchase Agreement, inclusive of all equipment, software, services, warranties, and applicable taxes, is an amount not to exceed $529,224.69 over the five-year term. Sufficient funds are budgeted and available in the Police Department's current operating budget, Account 1005000- 60015. To help offset the financial impact of the current fiscal year’s budget, two grant awards have been received and approved by the City Council. The awarded grant funds, totaling $38,893 will be applied toward the final project cost, along with a buy-back credit in the amount of $55,534.24, thereby reducing the financial obligation to the City. Future expenditures will be included in future budget years.
