Signature Sculpture Agreement Amendment
“Obtain council approval for all contracts for commission of, and maintenance for, works of art in any amount. Under the direction of the council, the commission will act to see that the terms of any agreements are carried out...”
On June 4, 2026, the Public Arts Commission recommended approval to the City Council of Amendment No. 5 to the Agreement to include nine newly installed art pieces to the cleaning and maintenance contract, add funding for existing art pieces for contract year 5, and expand services to include art installation and de-installation coordination services.
STAFF ANALYSIS:
On September 12, 2022, the City of Palm Springs entered into Agreement No. A9206 with Same Day Express, dba Signature Sculpture (Contractor), for the cleaning and maintenance of public art within the City. The original three-year agreement had a contract price of $128,905.
The agreement has previously been amended four times:
Amendment No. 1 (March 13, 2023): added services for the repair of the "Chairman of the Links" art piece, in the amount of $895.00, bringing the total contract price to an amount not to exceed $129,800.
Amendment No. 2 (February 3, 2025): expanded the scope of work to include seven art pieces at the Palm Springs International Airport, increasing the contract amount by $9,999.50, bringing the total contract amount to $139,799.50 and extended the contract term to August 31, 2027.
Amendment No. 3 (December 10, 2025): Added 11 newly installed art pieces to be incorporated into the annual cleaning schedule for an additional amount of $50,000 and a revised contract amount not to exceed $189,799.50, for contract year 4. This included the Pillars pieces on East Tahquitz Canyon Way, and Creature Alley on W. Chino Drive. It should be noted that the Public Art Commission did not request appropriation of funds in Amendment 3 for the nine additional pieces included in the proposed Amendment 5, nor funding for existing art pieces in contract year 5. Rather they requested that action be brought back following the installation of those additional nine pieces. Amendment No. 4 (August 13, 2026): expanded the scope of work to include the necessary cleaning, waxing, and restoration services to prepare seven artworks on loan from the Palm Springs Art Museum for return from Palm Springs International Airport, for an additional amount of $8,400, and a revised not to exceed amount of $198,199.50. These services were paid for utilizing Airport funds and therefore the amendment was authorized administratively for this one-time increase in services.
As proposed, Amendment No. 5 expands the scope of services to include the biannual cleaning and maintenance of nine (9) additional art pieces, bringing the total number of City Council Staff Report

pieces being serviced annually to 58 artworks. The new additions include the four Artscape in the Parks pieces: Dragonfly Bench, two new Creature Alley pieces, the Pride Monument, and Fossils of the Future. As detailed in Exhibit A4 of Amendment No. 5, maintenance for these items will primarily consist of washing with non-ionic soap and deionized water, followed by a wax application. The larger pieces incur more costs as they require time to set up scaffolding as part of the cleaning and maintenance process.
Additionally, this Amendment No. 5 adds funding for the existing 49 pieces of artwork for contract year 5, and coordination services for the installation and de-installation of artwork.
Staff recommend approval of Amendment No. 5, including $58,845 for the existing artwork (original agreement plus Amendments 1–4, see Attachment C), $41,680 for the nine new pieces, and $20,000 for installation, de-installation, and logistics planning for the Palm Springs Art Collection for a total additional amount of $120,525 and a total revised contract amount not to exceed $318,724.50. This Amendment 5 ensures that the City's growing collection of public art is properly and professionally maintained, preserving the condition and longevity of these valuable community assets.
ENVIRONMENTAL ASSESSMENT:
Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment, and which are exempt from the provisions of CEQA.
In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment and are declared to be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15304 "Minor Alterations to Land," Class 4 projects consist of "minor public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of healthy, mature, scenic trees except for forestry and agricultural purposes" and approval of this item is considered categorically exempt from CEQA.
ALIGNMENT WITH STRATEGIC PLANNING:
This item aligns with the following City Council Strategic Plan Broad Goal: Infrastructure and Facilities.
FISCAL IMPACT:
This action will increase the annual compensation under Agreement No. A9206 to $120,525, for a total contract not to exceed amount of $318,724.50. Funds for these services are in the Public Arts Fund budget.
