Ordinance No. _____
ORDINANCE NO. ____
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, AMENDING CHAPTER 5.25
REGARDING EVENT HOUSE USE AT A VACATION RENTAL
City Attorney’s Summary
This ordinance updates a regulatory provision contained in the City’s Vacation Rental ordinance regarding Event House use at a Vacation Rental and removes the current
requirement that each Event House event be counted as a Contract toward the property's annual Contract limit under Section 5.25.070.
WHEREAS, on November 10, 2022, the City Council of the City of Palm Springs adopted Ordinance No. 2075, which amended and restated the Chapter 5.25 of the Palm Springs Municipal Code; and
WHEREAS, Ordinance No. 2075 included a regulation that provides that when a Vacation Rental, including a Junior Vacation Rental, is also used as an Event House under Chapter 5.75, each Event House event is counted as a Contract for purposes of the property's annual Vacation Rental Contract limitation; and WHEREAS, The City regulates Event Houses and Vacation Rentals through separate provisions of the Palm Springs Municipal Code; and WHEREAS, Although the two programs regulate distinct activities, some residential properties maintain both an Event House business license and a Vacation Rental Registration Certificate.
WHEREAS, on October 22, 2025, the City Council directed consideration of whether Event House events should continue to count toward a property's annual Vacation Rental Contract limitation return as part of the future discussion of the Event House Ordinance; and
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Section 5.25.070 subdivision (w) of the Palm Springs Municipal Code is hereby repealed in its entirety:
55575.18195\45010526.1
Ordinance No. _____
“(w) For any vacation rental, including any junior vacation rental, that is also used as an event house, as that term is used in Palm Springs Municipal Code Chapter 5.75, each event shall be counted as a Contract, for purposes of Section
5.25.070's annual caps on the number of contracts, for such property”.
SECTION 2 : This Ordinance is not subject to the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) pursuant to Section 15060(c)(2) and 15060(c)(3) of the State Guidelines, because the Ordinance will not result in a direct or reasonably foreseeable indirect physical change in the environment and is not a "project," as that term is defined in Section 15378 of the State Guidelines. In addition, the City Council also determines this Ordinance consists of regulations intended to ensure that the incidental short term rental use of residential property remains an ancillary and secondary use of residential property in the City and thereby preserve the residential character of the City's single- family and multi-family neighborhoods as identified in the City's adopted General Plan, and its concomitant Environmental Impact Report. Thus, to the extent there is any environmental impact from the adoption of this Ordinance, the City Council finds that the Environmental Impact Report for the adopted General Plan is the controlling environmental document.
