SUBJECT: APPROVE AMENDMENT NO. 1 TO ON-CALL PROFESSIONAL SERVICES AGREEMENT NO. A8877 WITH MARKS ARCHITECTS, INC.
FOR A ONE-YEAR EXTENSION TO COMPLETE THE DEMUTH PARK
DEVELOPMENT PROJECT, CITY PROJECT 21-16 AND THE VICTORIA PARK RESTROOM, CITY PROJECT 18-06

SUMMARY:
This action will approve Amendment No. 1 to On-Call Professional Services Agreement No. A8877 with Marks Architects, Inc. extending the agreement for one year, from July 1, 2026 through June 30, 2027, solely to complete construction administration and closeout for the Demuth Park Development, City Project 21-16 and Victoria Park Restroom, City Project 18-06.
RECOMMENDATION:
1) Approve Amendment No. 1 to Professional Services Agreement No. A8877 with Marks Architects, Inc., extending the term for one year, from July 1, 2026 through June 30, 2027, solely to complete construction administration and closeout for the Demuth Park Development Project, City Project 21-16, and the Victoria Park Restroom, City Project 18-06; and
2) Authorize the City manager or his designee to execute all necessary documents.

The Public Integrity Disclosure form for Marks Architects is included as Attachment A.
BACKGROUND:
In 2021, the City entered into Professional Services Agreement No. A8877 with Marks Architects, Inc. for on-call architectural services. Under the agreement, Marks Architects was assigned to provide design and construction administration services for restroom improvements at Demuth Park and Victoria Park. Both projects are currently under City Council Staff Report

Approve Amendment No. 1 to Extend On-Call Agreement A8877 with Marks Architects construction. However, the agreement expired on June 30, 2026, before construction and the associated architectural services were completed.
STAFF ANALYSIS:
Marks Architects prepared the design documents for both projects and is providing construction administration, including responses to requests for information, submittal reviews, design clarifications and changes, punch-list support, and project closeout.
Continuing with Marks Architects will maintain continuity with the architect familiar with each project's design and construction history and avoid the delay, duplicated effort, and added cost of transitioning during construction. The one-year extension is limited to services necessary to complete these two projects and authorizes no new on-call assignments.
Staff recommends approval of Amendment No. 1 to extend Agreement No. A8877 from July 1, 2026, through June 30, 2027, allowing Marks Architects, Inc. to complete the assigned work. Amendment No. 1 is provided as Attachment B.
ENVIRONMENTAL ASSESSMENT:
In accordance with the California Environmental Quality Act (“CEQA”) Guidelines Section 15301(c) “Existing Facilities”, Class 1 projects consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. Therefore, Staff have determined that the Demuth Park Development Project, City Project 21-16, and Victoria Park Restroom, City Project 18-06 are considered categorically exempt from CEQA and a Notice of Exemption has been filed with the Riverside County Clerk.
ALIGNMENT WITH STRATEGIC PLANNING:
This item aligns with the following City Council Strategic Plan Broad Goal: Infrastructure and Facilities.
FISCAL IMPACT:
Amendment No. 1 extends the agreement term for one year and authorizes no additional compensation. Remaining services will be performed under the existing task orders and paid from the approved project budgets.
