Re: Monthly Report on Investments
December 7th, 2022
DISCUSSION
Compliance with Investment Policy
For October, the invested portfolio amount for the City of Palmdale totaled $288,288,744 an increase of $393,791 from the previous month, and an increase of $55,398,641 in comparison to last year. The increase is due to interest earned during this period.
The par value of Successor Agency’s portfolio as of October was $6,163,579. The balance increased by $12,689 from the last month due to interest earned during the month.
All investments meet criteria appropriate to Section 8 of the Investment Policy. The portfolios are based on a combination of various investments, including CDs, Corporate Notes, U.S. Treasury Securities and Government Agency Paper, each adhering to portfolio percentage limitations.
The Finance Division is the custodian for the City and Successor Agency’s investment portfolio and follows the three main principles of both entity’s investment policy to 1) Investment in financial instruments that mitigate the risk of monetary losses stemming from market fluctuations; 2) Establish and maintain a portfolio that has sufficient liquidity to allow the City and Successor Agency to meet all anticipated cash requirements; and 3) Seek out investment instruments that provide a competitive market rate of return.
Liquidity
One core approach the Finance Division focuses on, is providing liquidity to measure up to the City and Successor Agency’s operational requirements. Thus, the Finance Department is currently investing in two pooled funds, LAIF and CAMP. These are intended for the daily operational activities, used for economic uncertainties and maintenance needs. The pooled funds provide a higher liquidity ratio to ensure the City and Successor Agency meet cash flow requirements.
Total LAIF balance for the City of Palmdale at the end of October is $112,938,309, no changes compared to the prior month.
Successor Agency LAIF balance at the end of September was $5,407,822, an increase of $372,162 from the previous month.
CAMP’s balance for City of Palmdale at the end of October is $251,361 compared to September balance of $250,692 a slight increase due to interest earned. The interest rates presented are the most current rates available as of the date of this report. As of October 31, 2022, the interest rates for LAIF and CAMP investments were at 1.772 Report to Mayor and City Council

percent and 3.14 percent, respectively. By comparison, the LAIF and CAMP interest rates at the end of September were at 1.513 percent and 2.61 percent. Both rates have slightly increased within this month. This time last year, LAIF and CAMP rates were at 0.203 percent and 0.05, respectively.
The chart above shows both the Local Agency Investment Fund and California Asset Management Program’s average monthly yields beginning January 2022 through October 2022.
We anticipate that rates will begin to level off in the upcoming months, considering the current state of the economy. In recent months, CAMP shows better performance than LAIF in interest rates, however, the historical trend shows that LAIF rates generally outperform CAMP rates. The difference between the performance of the two funds is partly due to the varying pool characteristics. CAMP’s portfolio composition is much more subject to market volatility, resulting in performance variation.
Diversity
The Finance Division aims to diversify the investment portfolios to avoid incurring unreasonable and avoidable risks regarding specific security types or individual financial institutions.
City of Palmdale and Successor Agency’s investment portfolios remain strongly diversified. The monthly reports include all investments held by both entities and current book values as of October 31, 2022.
It is anticipated that both the City of Palmdale and Successor Agency will have sufficient moneys to meet its expenditure requirements for the next 6 months as we

1. Special Tax Annual Report
LOCAL AGENCY SPECIAL TAX AND BOND ACCOUNTABILITY ACT
Senate Bill 165, filed with the Secretary of State on September 19, 2000, enacted the Local Agency Special Tax and Bond Accountability Act (the “Act”). This Act requires that any local special tax or local bond measure subject to voter approval contain a statement indicating the specific purposes of the special tax, require that the proceeds of the special tax be applied to those purposes, require the creation of an account into which the proceeds shall be deposited, and require an annual report containing specified information concerning the use of the proceeds. The Act only applies to any local special tax measure or local bond measure adopted on or after January 1, 2001 in accordance with Section 50075.1 or Section 53410 of the California Government Code.
Some of the requirements of the Act are handled at the formation of the Special Tax District and others are handled through annual reports. This Section of this report intends to comply with Sections 50075.3 and 53411 of the California Government Code that states:
“The chief fiscal officer of the issuing local agency shall file a report with its governing body no later than January 1, 2002, and at least once a year thereafter. The annual report shall contain all of the following:
1. The amount of funds collected and expended.
2. The status of any project required or authorized to be funded as identified in subdivision (a) of Sections 50075.1 [and] 53410.”

City Council Staff Report
DATE: DECEMBER 7, 2022
TO: HONORABLE MAYOR AND CITY COUNCIL
FROM: CITY ATTORNEY’S OFFICE
DISTRICT: ALL
SUBJECT: ADOPT RESOLUTION NO. CC 2022-121, A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF PALMDALE MAKING
LEGALLY REQUIRED FINDINGS AND EXTENDING REMOTE
TELECONFERENCE PARTICIPATION FOR MEETINGS OF
THE CITY COUNCIL AND/OR ITS RELATED OR
SUBORDINATE LEGISLATIVE BODIES
ISSUE
Adopt Resolution No. CC 2022-121, a Resolution of the City Council of the City of Palmdale authorizing remote teleconference participat ion for meetings of the City Council and/or its subordinate legislative bodies for an additional 30-day period.
RECOMMENDATION
Staff recommends that the City Council:
1. Approve the resolution to thereby extend, for an additional 30-day period, the authority of the City Council, and all related and/or subordinate legislative bodies, to participate remotely in properly noticed meetings.
BACKGROUND
Since October 1, 2021 and through January 1, 2024, AB 361 has temporarily amended the Ralph M. Brown Act (California Government Code § 54950 et seq.) to provide more flexibility regarding participation in public meetings from a remote location. In layman’s terms AB 361 allows “zoom” meetings if specified requirements are met.
If the City Council authorizes remote meetings, such initial authorization must expire no later than 30 days from the initial authorization. The City Coun cil is authorized to thereafter extend the authorization if it makes one of various specified findings.
AB 361 requires several procedural safeguards to protect public participation during a remote meeting, key ones of which are summarized as follows:
1. The public must have the ability to address the legislative body directly and must be given information on how to address the legislative body;
2. The public must be provided with either a call-in or internet-based service option;
3. The legislative body must stop the meeting if the call-in or internet-based option fails;
Report to Mayor and City Council
Re: Resolution No. CC 2022-121
December 7, 2022
4. The legislative body cannot require that public comments be submitted in advance (although this option can be provided);
5. Public speakers cannot be required to pre-register for public comment (except as required by an independent call-in or internet platform);
6. Members of the public must be given a reasonable time to register to provide public comment; and
7. Agencies that provide a timed public comment period shall not close the public comment period until that time period has expired.
DISCUSSION
The City Council adopted an initial AB 361 Resolution on June 15, 2022. This resolution has been extended multiple times. The most recent extension is set to expire on December 16, 2022. The question before the City Council is whether to extend this authority for an additional 30-day period. An extension of authority to remotely participate is allowed if (1) the state of emergency continues, and (2) a resolution with required findings has been adopted within the last 30 days.
The proposed resolution would be immediately effective and allow members of legislative bodies to continue to participate remotely for an additional thirty days if the agenda for the meeting has included the legally required participation noticing. The resolution would also allow the City Manager (or designee) to opt to not include such noticing, as there may be instances where it would be impractical, due to staffing considerations, to allow remote participation in meetings.
FISCAL IMPACT
There is no fiscal impact associated with this action.
STRATEGIC PLAN
Goal II: Ensure long-term fiscal health of the City and maintain funding for services.
C. Involve and expand engagement to enhance public oversight and transparency.

DISTRICT: 1 AND 2
SUBJECT: APPROVE SUPPLEMENTAL AGREEMENT NO. 1 WITH MANHOLE ADJUSTING, INC., FOR PN 866, SEWER MANHOLE ADJUSTMENTS
AND REHABILITATION PROJECT, IN THE AMOUNT OF $53,550 AND
DETERMINE THIS ACTION IS CATEGORICALLY EXEMPT FROM
THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA).
ISSUE
Approve Supplemental Agreement No. 1 with Manhole Adjusting, Inc., for PN 866, Sewer Manhole Adjustments and Rehabilitation Project, in the amount of $53,550, and determine this action to be exempt under CEQA.
RECOMMENDATION
Staff recommends that the City Council:
1. Approve Supplemental Agreement No. 1 to Agreement No. A-7955 with Manhole Adjusting, Inc., for PN 866, Sewer Manhole Adjusting and Rehabilitation Project, in the amount of $53,550.
2. Determine this action to be exempt from the California Environmental Quality Act pursuant to 14 CCR § 15301 (“Existing Facilities”) and pursuant to the “catch -all” exemption of 14 CCR § 15061.

BACKGROUND
Capital Improvement Project No. 866 provides for the full repair and/or adjustment of 90 existing sewer manholes in various locations throughout the City. The scope of work includes the following: locate and expose manholes, coordinate with applicable agencies, notify residents and business owners, implement traffic control, prepare site for construction, saw -cut and remove pavement, excavate manhole p erimeters, construct temporary false bottoms, bypass sewer flow, remove and reconstruct damaged concrete benches and channels, adjust manhole frames and covers to grade, install new manhole frames and covers, construct concrete collar/pad, salvage function al materials, and restore pavement surface to its original condition.
Report to Mayor and City Council
Re: Supplemental Agreement No. 1, Agreement No. A-7955
December 7, 2022
DISCUSSION
Supplemental Agreement No. 1 revises the project scope to include 17 additional manholes located on Rancho Vista Boulevard between 15th Street West and 30th Street West. The scope of work includes the following: adjust existing or install new manhole frame and cover to grade, construct concrete collar/pad, salvage functional materials, and restore pavement surface to its original condition.
CEQA
Staff finds that this action is categorically exempt under CEQA Guidelines § 15301(c) which exempts maintenance and minor alteration of existing facilities, including repairs to existing facilities, such as structures within streets. The project is also exempt under 14 CCR 15061(b)(3), the “common sense exemption,” because CEQA applies only to projects which have the potential for causing a significant effect on the environment where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.
FISCAL IMPACT
This project is funded through Sewer Maintenance funds, which have been allocated in Account No. U0004. The total cost for the project can be seen in the following table:

The City reviewed and approved Zoning Clearance (Z22-538) determining that the proposed use is allowable within the proposed location . SUBJECT: INTRODUCE AND ADOPT ORDINANCE NO. U-1602, AN URGENCY
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALMDALE
AMENDING IN ITS ENTIRETY SECTIONS 3.14.010 AND 3.14.020 OF
THE PALMDALE MUNICIPAL CODE REGARDING THE SIGNATURE
AUTHORITY FOR SIGNING OF CHECKS AND WARRANTS.
ISSUE
Introduce and adopt Ordinan ce No. U-1602 amending in its entirety sections 3.14.010 and 3.14.020 of the Palmdale Municipal Code regarding the signature authority for signing of checks and warrants.
RECOMMENDATION
Staff recommends that the City Council conduct a public hearing and then introduce and adopt Ordinance No. U-1602.
BACKGROUND
In 1999 the City Council established procedures and signing authority for payroll warrants or checks, and warrants or checks drawn for payment by the City of Palmdale, as set forth in the Palmdale Municipal Code Sections 3.14.010 and 3.14.020. Current procedures require the Mayor or the Mayor Pro Tem to be one of the required signatories.
DISCUSSION
In March 2022, the City Council adopted Ordinance 1579, setting forth voting district boundaries. The City Council also voted to move forward with five districts and a rotating Mayor, eliminating the at -large Mayor position effective with the November 8, 2022 general election. Due to the upcoming change in Mayor, there is an urgency to adopt this ordinance amending Sections 3.14.010 and 3.14.020 of the Palmdale Municipal Code to revise the authorized signatories . There is a possibility that the change may leave the City without a required signatory for a period of time. Therefore, it is being proposed that the City Council adopt Urgency Ordinance No. U -1602 amen ding the required signatory to include the City Manager and one of the following: the Assistant City Manager, Director of Finance, Deputy Director of Finance, City Treasurer, or the Report to Mayor and City Council
Re: Urgency Ordinance U-1602 Regarding Check Signers

Deputy City Treasurer, and to remove the Board of Library Trustees, as there is no longer a separate bank account.

FISCAL IMPACT
There is no fiscal impact associated with the recommended action for this report.
