THE CITY COUNCIL OF THE CITY OF PALMDALE MAKING
LEGALLY REQUIRED FINDINGS AND EXTENDING REMOTE
TELECONFERENCE PARTICIPATION FOR MEETINGS OF
THE CITY COUNCIL AND/OR ITS RELATED OR
SUBORDINATE LEGISLATIVE BODIES
ISSUE
Adopt Resolution No. CC 2022-122, a Resolution of the City Council of the City of Palmdale authorizing remote teleconference participat ion for meetings of the City Council and/or its subordinate legislative bodies for an additional 30-day period.
RECOMMENDATION
Staff recommends that the City Council:
1. Approve the resolution to thereby extend, for an additional 30-day period, the authority of the City Council, and all related and/or subordinate legislative bodies, to participate remotely in properly noticed meetings.
BACKGROUND
Since October 1, 2021 and through January 1, 2024, AB 361 has temporarily amended the Ralph M. Brown Act (California Government Code § 54950 et seq.) to provide more flexibility regarding participation in public meetings from a remote location. In layman’s terms AB 361 allows “zoom” meetings if specified requirements are met.
If the City Council authorizes remote meetings, such initial authorization must expire no later than 30 days from the initial authorization. The City Council is authorized to thereafter extend the authorization if it makes one of various specified findings.
AB 361 requires several procedural safeguards to protect public participation during a remote meeting, key ones of which are summarized as follows:
1. The public must have the ability to address the legislative body directly and must be given information on how to address the legislative body;
2. The public must be provided with either a call-in or internet-based service option;
3. The legislative body must stop the meeting if the call-in or internet-based option fails;
Report to Mayor and City Council
Re: Resolution No. CC 2022-122
December 21, 2022
4. The legislative body cannot require that public comments be submitted in advance (although this option can be provided);
5. Public speakers cannot be required to pre-register for public comment (except as required by an independent call-in or internet platform);
6. Members of the public must be given a reasonable time to register to provide public comment; and
7. Agencies that provide a timed public comment period shall not close the public comment period until that time period has expired.
DISCUSSION
The City Council adopted an initial AB 361 Resolution on June 15, 2022. This resolution has been extended multiple times. The most recent extension is set to expire on January 6, 2023. The question before the City Council is whether to extend this authority for an additional 30-day period. An extension of authority to remotely participate is allowed if (1) the state of emergency continues, and (2) a resolution with required findings has been adopted within the last 30 days.
The proposed resolution would be immediately effective and allow members of legislative bodies to continue to participate remotely for an additional thirty days if the agenda for the meeting has included the legally required participation noticing. The resolution would also allow the City Manager (or designee) to opt to not include such noticing, as there may be instances where it would be impractical, due to staffing considerations, to allow remote participation in meetings.
FISCAL IMPACT
There is no fiscal impact associated with this action.

SUBJECT: AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALMDALE REVISING MUNICIPAL CODE SECTION 2.08.010
REGARDING THE SELECTION OF THE MAYOR AND MAYOR PRO
TEM
ISSUE
Introduction and adoption of Ordinance No. U-1604, an Urgency Ordinance of the City Council of the City, revising Municipal Code Section 2.08.010 regarding the selection of the Mayor and Mayor Pro Tem. Also consider alternate versions ofsaid ordinance, such as a non-urgency ordinance.
RECOMMENDATION
Staff recommends that the City Council:
1. Hold a public hearing to accept public testimony; and
2. Consider whether to a dopt Ordinance No. U-1604 on an urgency basis and/or whether to propose amendments to such proposed ordinance.
BACKGROUND
Until the November 2022 election, the position of mayor had been directly elected by the electorate at large.
Palmdale Municipal Code 2.08.010 currently establishes that the for the one-year period following the election, the person serving as Mayor is to be decided by lot (i.e., by random selection), and then at the end of the first year, theposition of mayor would rotate annually when it provides:
“Elected Mayor. The office of the Mayor of the City shall, beginning at the end of the elected Mayor’s term, be filled by one of the Councilmembers.
The district from which the office of Mayor is initially filled shall be decided by lot as soon thereafter as reasonably practicable. Thereafter, the office of Mayor shall rotate every one year and will be decided by a majority of the City Council.”
The City Council has the option to amend the municipal code’s provisions regarding the procedure to select the Mayor and/or the position of Mayor Pro Tem.
Report to Mayor and City Council
Re: Urgency Ordinance No. 1602 – Mayoral and Mayor Pro Tem Selection
The proposed ordinance would do the following:
Annual Reorganization. Establish that each year, a majority of the City Council is to select who will serve as Mayor and Mayor Pro Tem. In even-numbered years that decision is to occur immediately after the new City Council takes office (in the November/December time frame). In years when there are no City Council election results to be canvassed following a November election (typically, odd- numbered years), the City Council shall make such selections during the first regular City Council meeting of December. In years when there are election results to be canvassed following a November election (typically, even numbered years), the City Council shall make such selections at the same City Council meeting at which the City Council confirms the official canvass of the municipal election results consistent with Government Code 36801, and California Elections Code 10261 and 10262. In other words, in most instances, the position of mayor would be voted on each December or thereabouts.
Mayor / Mayor Pro Tem Qualifications. The ordinance would make clear that a person shall not become mayor or mayor pro tem if that person declines the position.
Vacancies. If the position of Mayor is vacant, the Mayor Pro Tem would become the Mayor. If the position of Mayor Pro Tem is vacant, it would remain vacant until filled by the Council majority.
Removal. Even though the City Council is required to yearly determine who is to be Mayor and Mayor Pro Tem, the City Council always retains the discretion to remove/replace the Mayor and Mayor Pro Tem.
Immediately Effective. The proposed ordinance is crafted as an urgency ordinance, and would become immediately effective if approved by no less than four members of the city council. If adopted, the City Council would select the Mayor and Mayor Pro Tem based upon the newly adopted ordinance. If only three members vote to approve the ordinance, then it could become effective as early as the 31st day after adoption. Upon it becoming effective, the Council majority could select a new Mayor and/or Mayor Pro Tem based upon the newly effective ordinance.
The proposed ordinance does not do any of the following:
Impose Term Limits. The ordinance does not prohibit the City Council from voting to reappoint any particular Mayor and/or Mayor Pro Tem. Conflict with Resolution 2017-008. Section 2 of existing City Council resolution 2017-008 establishes that the City Council has the authority to select the Mayor Pro Tem. This is still true. The only difference is that in addition to the authority stated in Section 2, if this ordinance is adopted, the Council’s selection is subject to the requirements of subsection C of the newly proposed ordinance which indicates that the council may not appoint someone who has declined to serve as Mayor Pro Tem in that particular instance. The ordinance does not change the Report to Mayor and City Council
Re: Urgency Ordinance No. 1602 – Mayoral and Mayor Pro Tem Selection
portions of Resolution 2017-008 which establish that the Mayor Pro Tem is to serve as the Vice Chair of the Successor Agency, the Palmdale Airport Authority, the Palmdale Civic Authority, and as the Chair Pro Tem of the Industrial Development Authority.

“2.08.010 – Elected Mayor.
The office of the Mayor of the City shall, beginning at the end of the elected Mayor’s term, be filled by one of the Councilmembers. The district from which the office of Mayor is initially filled shall be decided by lot as soon thereafter as reasonably practicable. WHEREAS, a mayor has substantial influence as to the overall political climate of the city, and a mayor can contribute to either discord or harmony, and can greatly impact the overall environment of the city such that this ordinance is necessary for the immediate preservation of the public peace, health and safety;
WHEREAS, the existing Municipal Code does not establish how the Mayor Pro Tem is selected from the members of the City Council;
WHEREAS, the existing Municipal Code does not provide procedures for filling vacancies in the positions of Mayor and Mayor Pro Tem;
Urgency Ordinance: Mayoral and Mayor Pro Tem Selection
THE CITY COUNCIL OF THE CITY OF PALMDALE DOES ORDAIN AS FOLLOWS:
SECTION 1. Municipal Code Amendment. Municipal Code Section 2.08.010, currently entitled “Elected Mayor” shall be revised to provide as follows:
2.08.010. Selection of Mayor and Mayor Pro Tem
A. Annual Reorganization. Each year, a majority of the City Council shall select from among its members one person to serve as Mayor, and one person to serve as Mayor Pro Tem. In years when there are no City Council election results to be canvassed following a November election (typically, odd-numbered years), the City Council shall make such selections during the first regular City Council meeting of December. In years when there are election results to be canvassed following a November election (typically, even numbered years), the City Council shall make such selections at the same City Council meeting at which the City Council confirms the official canvass of the municipal election results consistent with Government Code 36801, and California Elections Code 10261 and 10262.
B. Mayoral Qualifications. A majority of the City Council shall select the Mayor from among those members who have not declined to serve as Mayor in this particular instance.
C. Mayor Pro Tem Qualifications. A majority of the City Council shall select the Mayor Pro Tem from among those members who have not declined to serve as Mayor Pro Tem in this particular instance.
D. Filling Vacancies. If there becomes a vacancy in the position of Mayor, then the Mayor Pro Tem shall be Mayor until a new Mayor is selected. If there is a vacancy in the position of Mayor Pro Tem, then the position of Mayor Pro Tem will be vacant until a new Mayor Pro Tem is selected.
E. Removal. At any properly noticed regular meeting, a majority of the City Council may vote to remove the Mayor or Mayor Pro Tem, and to replace such person consistent with the requirements of subsection B or C of this section, if applicable.
SECTION 2. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase in this Ordinance or any part thereof is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof irrespective of the fact that any one or more subsections, subdivisions, paragraphs, sentences, clauses or phrases be declared unconstitutional, or invalid, or ineffective, provided the basic purposes of this Ordinance and the benefits to the City and Urgency Ordinance: Mayoral and Mayor Pro Tem Selection
the public are not substantially impaired. For example, if it is determined that this ordinance could not become immediately effective, then this ordinance shall instead become effective on the 31st day after adoption. Furthermore, this ordinance shall not be interpreted as affecting Resolution 2017-008, except to the extent that the discretion of the council to appoint a Mayor Pro Tem pursuant to Section 2 of such resolution may be affected by new subsection C of Municipal Code section 2.08.010.
SECTION 3. CEQA. The City Council finds the approval of this ordinance is not subject to the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) because the activity is not a project as defined in Section 15378 because it has no potential for resulting in physical change to the environment, directly or indirectly. Alternatively, the City Council finds the approval of this ordinance is not a project under CEQA Regulation Section 15061(b)(3) because it has no potential for causing a significant effect on the environment.
SECTION 4. Effective Date. This Urgency Ordinance shall become effective immediately.
SECTION 5. Certification. The City Clerk shall certify to the adoption of this ordinance and shall cause this ordinance to be published or posted as required by law.
PASSED, APPROVED and ADOPTED this 21st day of December 2022. ________________________________

ISSUE
Selection of the Mayor.
RECOMMENDATION
Select the Mayor either pursuant to existing Palmdale Municipal Code 2.08.010, or if an urgency ordinance has been adopted which immediately amends the relevant procedures, appoint a Mayor consistent with such new procedures.
BACKGROUND
Palmdale Municipal Code 2.08.010 currently establishes that for the first year following the November 2022 election, the person serving as Mayor is to be decided by lot (i.e., by random selection), and at the end of the first year, the position of mayor would rotate annually:
2.08.010. “Elected Mayor .
DISCUSSION
If the City Council has not adopted an urgency ordinance at the December 21 meeting , then the selection of the Mayor is to occur “by lot” (i.e., at random). The City Clerk’s department will have available at the meeting the materials available to randomly select the first mayor.
If the City Council has adopted an urgency ordinance at the December 21 meeting, then the City Council would select the Mayor pursuant to that new ordinance.

SUBJECT: DISCUSSION AND POSSIBLE ACTION TO DECLARE A LOCAL EMERGENCY RELATED TO THE CITY OF LOS ANGELES’
PROPOSED RELOCATION OF HOMELESS TO A “VILLAGE” IN
PALMDALE
ISSUE
Discussion and possible action declaring a state of emergency related to the City of Los Angeles’ proposed relocation of homeless individuals to Palmdale.
RECOMMENDATION
Staff recommends that the City Council:
1. Discuss declaring a state of emergency;
2. Take public comment;
3. Declare a state of emergency related to the City of Los Angeles’ intent to relocate homeless populations to LA city or county owned land in Palmdale.
BACKGROUND
Karen Bass was elected to the office of Mayor of Los Angeles in November and sworn in December 11, 2022. In her first act as mayor, she declared a state of emergency related to homelessness in the city of Los Angeles. More specifically, in an interview given and published on May 7, 2022, when asked about how she would address the homelessness issue she responded, “ There’s a big chunk of land in Palmdale and maybe we could create a village o ut there.” Palmdale City Council immediately denounced then mayoral candidate Bass’ comments and invited her to visit Palmdale to work collaboratively on solutions before trying to export her city’s homeless to our community. She has yet to accept our offer. Bass’ emergency order allows her to demand that departments identify all city-owned properties that can be used for some form of housing. The City of Los Angeles owns approximately 17,000 acres of bare land with few if any improvements in and around the Plant 42 installation.
Report to Mayor and City Council
Re: Resolution Proclaiming a Local Emergency Regarding Homelessness December 21, 2022
DISCUSSION
There exists little to no infrastructure or services in place to effectively manage and assist in addressing this crisis. The idea that Los Angeles could export homelessness problems on Palmdale’s working class, family-oriented desert community on an emergency basis, without allowing time for community and cross-agency communications is deeply disturbing. Rather the City of Los Angeles should take the time to collaborate on equitable, community-based solutions to address this humanitarian crisis.
A declaration of emergency would allow the City of Palmdale to activate an emergency operations team in response to this proposal. It would allow Palmdale to have the tools and resources necessary to mitigate the negative impacts of actions which are taken on an emergency basis and which could permanently and negatively impact the safety of persons and property within Palmdale. Granting such tools would encourage the City of Los Angeles to work cooperatively with Palmdale, and all its neighboring jurisdictions to create sustainable, rather than unnecessarily rushed and damaging short term “solutions.”
FISCAL IMPACT
Unknown but estimated in the hundreds of thousands to manage costs associated with dramatically increasing the local unhoused population to include social services, emergency response teams, health and safety needs, media, etc.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PALMDALE CALIFORNIA PROCLAIMING A LOCAL
EMERGENCY RELATED TO THE CITY OF LOS
ANGELES’ PROPOSED RELOCATION OF HOMELESS
TO A “VILLAGE” IN PALMDALE
WHEREAS, the Los Angeles Times has reported that there are currently more than 42,000 people who are homeless in the City of Los Angeles; WHEREAS, the City of Los Angeles owns approximately 17,000 acres of bare land with few if any improvements in and around Palmdale’s Plant 42 installation.
WHEREAS, on May 7, 2022, Karen Bass, when asked about how she would address the homelessness issue stated, “There’s a big chunk of land in Palmdale and maybe we could create a village out there”;
WHEREAS, on her first day of office, as the newly elected Mayor of Los Angeles, Karen Bass declared a state of emergency relating to homelessness; WHEREAS, Government Code 8634 states in part, “During a local emergency the governing body of a political subdivision, or officials designated thereby, may promulgate orders and regulations necessary to provide for the protection of life and property, including orders or regulations imposing a curfew within designated boundaries where necessary to preserve the public order and safety. Such orders and regulations and amendments and rescissions thereof shall be in writing and shall be given widespread publicity and notice.”
WHEREAS, it is currently unclear as to exactly what actions the City of Los Angeles would take to attempt to resolve the homeless crisis, and whether, or to what extent its emergency powers would be used to create a homeless “village”, and whether, and to what extent such village would cause negative secondary effects which would require immediate action to resolve;
WHEREAS, the City of Palmdale supports taking well-reasoned and long-term solutions to the ongoing issues relating to housing and homelessness, rather than short- term solution which, when not properly planned, can cause multiple negative and unplanned secondary impacts which can cause significant legal issues; WHEREAS, the Mayor of the City of Los Angeles declaring an emergency establishes extreme peril to the safety of persons and property within Palmdale, and such conditions are or are likely to be beyond the control of the services, personnel, equipment and facilities of this City, requiring the combined forces of other political subdivisions to Resolution No. CC 2022-123
combat;
WHEREAS, the City of Lancaster declared a state of emergency on similar grounds;
WHEREAS, the Palmdale City Manager serves as the City’s Director of Emergency Services, and such individual should be granted the legal authority to take actions which mitigate or prevent negative impacts on Palmdale from actions taken by the City of Los Angeles;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
SECTION 1. Declaration of Emergency. For the above reasons, the City Council declares the existence of a state of emergency in response to actions taken by the City of Los Angeles. Such state of emergency shall end on the 60 th day hereafter unless subsequently extended by action of the City Council, or prematurely terminated by the City Council. The City Manager, acting as the Director of Emergency Services, may only use this authority granted in response to actions which may occur (or which have occurred) directly or indirectly as a result of actions taken by the City of Los Angeles, including action taken in concert with or by other public or private entities.
SECTION 2. Certification. The City Clerk shall certify to the passage and adoption of this resolution.
